AGENDA REPORT <br />CITY OF COLTON <br />Office of the City Attorney <br />For City Council Meeting of <br />October 4, 1994 <br />September 28, 1994 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: Julie Hayward Biggs, City Attorney <br />SUBJECT: Fireworks Ordinance <br />Background: <br />Each year the City allocates a total of twelve licenses for the sale of fireworks <br />within the City to churches (3) youth groups (6) and civic organizations (3). Under the <br />ordinance governing this procedure, the Colton Unified School District may have only one <br />license in the youth group category. Councilmember Sandoval has requested that the City's <br />fireworks ordinance be revised to allow up to five firework licenses to be issued to youth groups <br />sponsored by the Colton Unified School District. In addition, the Director of Finance has <br />requested that administration of this licensing procedure be moved to another department. The <br />Fire Department, which is directly involved in all aspects of the licensing procedure, has <br />indicated a willingness to administer the program. <br />Recommendation: <br />The attached proposed ordinance re -defines "youth group" to include youth groups <br />sponsored by the Colton Unified School District and places a limit on school sponsored youth <br />groups of up to five of the total of six licenses that are allocated to that category. The ordinance <br />does not expand the total number of licenses available, although if the Council wishes to make <br />that change in the ordinance it could be done. The ordinance also places the responsibility for <br />administration of the program in the control of the fire department and the Fire Chief. <br />Fiscal effect: <br />So long as the total number of licenses is not expanded, no fiscal effect will result. If <br />the Council decides to increase that number, additional costs to the City would be involved in <br />the administration of the program and in the required police and fire services needed to monitor <br />compliance with the ordinance and safety standards. <br />4 X1 <br />
