VERALRUD <br />Deputy City Clerk <br />Approved this day of <br />Mayor <br />, 1977. <br />SPECIAL COUNCIL MEETING <br />May 31, 1977 <br />A Special Meeting of the City Council of the City of Colton was held on the above given date in the Council Chambers <br />of the Civic Center, located at 650 North La Cadena Drive, Colton, California, at 5:35 p.m., Mayor Beltran presid- <br />ing. <br />Notice of Special Meeting was given on May 27, 1977, in compliance with Government Code Section 54956. <br />Rni i r.AI i <br />Council members present were Hayes, Cisneros, Rehrer, Gonzales, and Mayor Beltran. Also present were Acting City <br />Manager Johnsen, City Attorney Edwards, and City Clerk Ramos. <br />ELECTIONS: <br />Labor Relations/Employee Representation <br />Acting City Manager Johnsen reported from his memorandum dated May 27, 1977, entitled "General Employees Representation <br />Election May 18, 1977". Mr. Johnsen reported that since preparation of his memorandum, he has been in contact with <br />the State Conciliation Service Office and has been informed by Mr. Drohan that the State Conciliation Office would <br />not be available on a Fact Finding basis but would be available on a mediation basis. <br />Mr. Johnsen further reported that Mr. Drohan has today, mailed a list of recommended professional Fact Finders; <br />and that the alternatives the Council could consider would then be as follows: <br />1. Hire a Fact Finder. A cost would be involved. <br />2. Hire a Fact Finder and appoint a Staff Member to work in conjunction with <br />Fact Finder. <br />3. Appoint an Ad Hoc Committee -to audit the conduct of the election. The Ad <br />Hoc Committee should be composed of people to this point neutral on the <br />election. <br />Councilman Hayes asked if the counter charges filed by AFSCME have been upheld. <br />Acting City Manager Johnsen replied that they have not, that allegations have been filed not specific charges. <br />Mr. Johnsen stated according to the City's consultant there is a need for a evidentuary hearing, so that the <br />specific charges can be heard and a determination made as to the validity of the charges and as to whether they <br />would invalidate the election. <br />Mr. Johnsen concluded by saying that the Council would be the final determining body upon receiving a report as a <br />result of one of the three alternates. <br />Councilman Hayes stated in his opinion, there is no need for further deliberations by anyone in this matter, the <br />election has been held, a winner has been determined, the election process is over. Councilman Hayes compared the <br />election to a ball game, when the game is concluded - there is a winner and there is a loser. <br />Moved by Councilman Hayes, seconded by Councilwoman Cisneros, that the City Clerk's reports with regards to the <br />results of the election are accepted by the Council as being correct and valid; and that the Council declares <br />that the winner of the election is as set out in the Certificate of the City Clerk who conducted the election. <br />Unanimous vote. <br />EXECUTIVE SESSION: <br />The City Council adjourned to Executive Sesssion at 5:45 p.m., to discuss Personnel Matters.
