1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ORDINANCE NO. 1430 AN ORDINANCE REQUIRING THE PAYMENT OF A FEE AS A CONDITION OF APPROVAL FOR FINAL SUBDIVI- SION MAP OR AS A CONDITION OF ISSUING A BUILD- ING PERMIT FOR PURPOSES OF DEFRAYING THE ACTUAL OR ESTIMATED COST OF CONSTRUCTING BRIDGES. WHEREAS, Section 11547 of the Business and Professions Code of the State of California authorizes cities to adopt ordinances requiring payment of fees as a condition of approval of a final subdivision map or as a condition of issuing a building permit, such fees to be used for purposes of defraying the actual or estimated cost of constructing bridges; and WHEREAS, the City Council deems it in the best interest of the people of the City of Colton to impose such changes: NOW, THEREFORE, THE CITY OF COLTON ORDAINS AS FOLLOWS: Section 1. The City of Colton (the "City") has adopted a circulation element of its General Plan, and the flood control provisions thereof identify streams for which bridget corssings are required on said General Plan or on local roads. Section 2. With regard to any proceedings under this ordinance the following procedure shall apply: a. For each area proposed to be benefited by the construction of bridge facilities, a public hearing shall be held by the City Council of the City of Colton. Notice shall be given pursuant to Section 65905 of the Government Code of the State of California. In addition to the requirements of Section 65905 of said Government Code, such notice shall also contain preliminary information related to the boundaries of the area of benefit, the estimated cost of the facilities, and the method of fee apportionment. The area of benefit may include land or improvements in addition to the land or improvements which are the subject of the subdivision map or building permit
