1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />29 <br />30 <br />31 <br />32 <br />ORDINANCE NO. 1430 <br />AN ORDINANCE REQUIRING THE PAYMENT OF A FEE <br />AS A CONDITION OF APPROVAL FOR FINAL SUBDIVI- <br />SION MAP OR AS A CONDITION OF ISSUING A BUILD- <br />ING PERMIT FOR PURPOSES OF DEFRAYING THE ACTUAL <br />OR ESTIMATED COST OF CONSTRUCTING BRIDGES. <br />WHEREAS, Section 11547 of the Business and Professions <br />Code of the State of California authorizes cities to adopt ordinances <br />requiring payment of fees as a condition of approval of a final subdivision <br />map or as a condition of issuing a building permit, such fees to be used for <br />purposes of defraying the actual or estimated cost of constructing bridges; <br />and <br />WHEREAS, the City Council deems it in the best interest of the <br />people of the City of Colton to impose such changes: <br />NOW, THEREFORE, THE CITY OF COLTON ORDAINS AS FOLLOWS: <br />Section 1. The City of Colton (the "City") has adopted a <br />circulation element of its General Plan, and the flood control provisions <br />thereof identify streams for which bridget corssings are required on said <br />General Plan or on local roads. <br />Section 2. With regard to any proceedings under this ordinance <br />the following procedure shall apply: <br />a. For each area proposed to be benefited by the construction <br />of bridge facilities, a public hearing shall be held by the City Council of <br />the City of Colton. Notice shall be given pursuant to Section 65905 of the <br />Government Code of the State of California. In addition to the requirements <br />of Section 65905 of said Government Code, such notice shall also contain <br />preliminary information related to the boundaries of the area of benefit, the <br />estimated cost of the facilities, and the method of fee apportionment. The <br />area of benefit may include land or improvements in addition to the land or <br />improvements which are the subject of the subdivision map or building permit <br />
