2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />ORDINANCE NO. 0-02-10 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLTON <br />AMENDING AND RESTATING SECTIONS 9.27.080, 9.27.150, 9.27.160 <br />AND 9.27.220 AND ADDING SECTION 9.27.180.5 OF CHAPTER 9.27 OF <br />THE COLTON MUNICIPAL CODE REGARDING RECOVERY OF <br />COSTS FOR REMOVAL OF GRAFFITI <br />WHEREAS, the City of Colton spends a significant amount of public funds and other <br />resources to remove graffiti; and <br />WHEREAS, the City Council adopted an ordinance which declared graffiti a public <br />nuisance and amended Chapter 9.27 of the Colton Municipal Code to add graffiti removal <br />tools and provide for the recovery of City funds expended on graffiti removal and abatement <br />programs; and <br />WHEREAS, California Civil Code section 1714.1 provides for periodic increases in <br />the amount of damages that may be recovered from the parent of a minor whose willful <br />misconduct results in damage to property, including placement of graffiti; and <br />WHEREAS, since the passage of the City of Colton's graffiti ordinance, the <br />California Judicial Council has increased the amount of damages that may be recovered <br />regarding removal of graffiti, in accordance with the provisions of California Civil Code <br />section 1714.1; and <br />WHEREAS, to be consistent with the above described increases by the California <br />Judicial Council, the City Council now wishes to amend Chapter 9.27 of the Colton <br />Municipal Code to increase the amount that the City may seek from parents and minors in <br />recovering the costs for removal of graffiti; and <br />WHEREAS, as a further deterrent the City wished to impose administrative penalty <br />amounts that are applicable to violations of this Section. <br />THE CITY COUNCIL OF THE CITY OF COLTON ORDAINS AS FOLLOWS: <br />SECTION 1. Section 9.27.080 subsection A of Title 9, Chapter 9.27 of the Colton <br />Municipal Code is hereby amended in its entirety and restated to read as follows: <br />"A. Pursuant to California Government Code Section 53069.5, the city offers a reward of <br />five hundred dollars ($500) for information leading to the arrest and conviction of any person <br />for violation of California Penal Code Section 594 by the use of graffiti, not to exceed one <br />thousand dollars ($1,000) per incident of graffiti, for up to six months after such conviction." <br />SECTION 2. Section 9.27.150 of Title 9, Chapter 9.27 of the Colton Municipal Code <br />is hereby amended in its entirety and restated to read as follows: <br />"9.27.150 – Additional remedies—Recovery from parents of minors. <br />Pursuant to California Civil Code Section 1714.1(b), any parent or legal guardian <br />having custody or control of a minor who knowingly permits, or by insufficient control, <br />allows the minor to possess a graffiti implement without supervision thereof shall by jointly <br />- 1 - <br />
