I RESOLUTION NO. R-121-07 <br />2 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />3 COLTON, CALIFORNIA, TO SUMMARILY VACATE TWO (2) <br />ELECTRIC UTILITY TRANSMISSION RIGHT OF WAY PUBLIC <br />4 SERVICE EASEMENTS, PURSUANT TO STREETS AND <br />5 HIGHWAYS CODE SECTION 8330 ET SEQ. <br />WHEREAS, the City of Colton (the "City") has certain two (2) electric utility <br />6 <br />7 transmission right of way public service easements, which were inadvertently transferred to the City <br />8 by the Southern California Edison Company in the Final Order of Condemnation of an eminent <br />9 domain action in November 2004 (the "Edison Easements") ; and <br />10 WHEREAS, the Edison Easements generally traverse the real property located north <br />11 of Valley Boulevard in an area of the City commonly known as the "West Valley Boulevard Area" <br />12 <br />and are more specifically described in the attached Exhibit "A"; and <br />13 <br />14 WHEREAS, the Edison Easements are not required by the City for public right of <br />15 way purposes and are unnecessary for present or prospective public use; and <br />16 WHEREAS, Southern California Edison Company requires the Edison Easements in <br />17 order to access its existing electrical utility facilities in the area; and <br />18 <br />WHEREAS, the City has not used the Edison Easements for any purpose, or for any <br />19 <br />construction, or for any public services since November 19, 2004, the date of recordation of the Final <br />20 <br />21 Order of Condemnation in the above referenced eminent domain action, when the Edison Easements <br />22 were acquired by the City; and <br />23 WHEREAS, there are no public utility facilities that are located or in use by the City <br />24 within the Edison Easements; and <br />25 <br />WHEREAS, the City of Colton has no further use for the Edison Easements and the <br />26 <br />27 City Council desires to summarily vacate the Edison Easements and to authorize the City <br />28 Manager to execute the necessary documents to transfer and assign the Edison Easements to <br />the Southern California Edison Company; and <br />
