R-20-08 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, CALIFORNIA COVENANTING TO FORM A JOINT POWERS AUTHORITY WITH THE CITY OF RIALTO, THE COUNTY OF SAN BERNARDINO, AND THE WEST VALLEY WATER DISTRICT TO ADDRESS GROUNDWATER CONTAMINATION IN THE RIALTO COLTON BASIN WHEREAS, there is a critical need for a coordinated effort to develop, facilitate, finance, and implement groundwater treatment programs required of responsible parties in the I Rialto Colton Basin ("Critical Need"); and WHEREAS, the City of Rialto, the City of Colton, the West Valley Water District and I the County of San Bernardino are committed to form a Joint Powers Authority ("JPA") in order to efficiently and effectively address the Critical Need; and WHEREAS, the JPA will coordinate with federal, state, and local agencies and potentially responsible parties in developing, facilitating, and financing the implementation of groundwater treatment plans to ensure an efficient and effective cleanup effort by those responsible; and WHEREAS, the best interests of the City are served by being a member of the JPA. BE IT NOW THEREFORE RESOLVED AS FOLLOWS: SECTION 1. The City hereby commits to be a member of the JPA. SECTION 2. City staff is directed to work with the staff of the other named entities in order to prepare a proposed JPA agreement for consideration and adoption by the County and each of the named entities.
