R-31-17 <br />3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON <br />CONSENTING TO THE INCLUSION OF PROPERTIES WITHIN THE <br />4 TERRITORY OF THE CITY IN THE CALIFORNIA MUNICIPAL <br />FINANCE AUTHORITY OPEN PACE PROGRAMS; AUTHORIZING <br />5 THE CALIFORNIA MUNICIPAL FINANCE AUTHORITY TO ACCEPT <br />6 APPLICATIONS FROM PROPERTY OWNERS, CONDUCT <br />CONTRACTUAL ASSESSMENT PROCEEDINGS AND LEVY <br />7 CONTRACTUAL ASSESSMENTS WITHIN THE TERRITORY OF THE <br />8 <br />CITY; AND AUTHORIZING RELATED ACTIONS <br />9 WHEREAS, the California Municipal Finance Authority (the "Authority") is a <br />10 joint exercise of powers authority, the members of which include numerous cities and <br />11 counties in the State of California, including the City of Colton (the "City); and <br />12 <br />WHEREAS, the Authority is implementing Property Assessed Clean Energy <br />13 <br />14 (PACE) programs, which it has designated CMFA Open PACE, consisting of CMFA Open <br />15 PACE programs each administered by a separate program administrator (collectively with <br />16 any successors, assigns, replacements or additions, the "Programs"), to allow the financing <br />17 or refinancing of renewable energy, energy efficiency, water efficiency and seismic <br />18 <br />strengthening improvements, electric vehicle charging infrastructure and such other <br />19 <br />20 improvements, infrastructure or other work as may be authorized by law from time to time <br />21 (collectively, the "Improvements") through the levy of contractual assessments pursuant to <br />22 Chapter 29 of Division 7 of the Streets & Highways Code ("Chapter 29") within counties <br />23 and cities throughout the State of California that consent to the inclusion of properties <br />24 <br />within their respective territories in the Programs and the issuance of bonds from time to <br />25 <br />26 time; and <br />27 WHEREAS, the program administrators currently active in administering <br />28 Programs are Energy Efficient Equity, Inc.; BlueFlame PACE Services LLC; OnPACE <br />
