R-81-15 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON FINDING THAT THE PUBLIC INTEREST AND <br />CONVENIENCE REQUIRE THE SALE OF CERTAIN REAL <br />PROPERTY AND DECLARING ITS INTENT TO SELL SUCH <br />PROPERTY <br />WHEREAS, the City of Colton ("City") desires to sell certain property by <br />entering into a Disposition and Development Agreement (DDA") with Valley Orange <br />Enterprises, LLC, a California limited liability company ("Developer"); and <br />WHEREAS, Developer owns approximately 27,699 square feet of real property <br />generally located at the southwest corner of the intersection of Pepper Street and Valley <br />Boulevard, in the City (APN 254-181-09) and legally described in Exhibit "A-1" attached <br />to this resolution and incorporated by reference herein ("Developer Parcel"); and <br />WHEREAS, the County of San Bernardino ("County") owns approximately <br />19,144 square feet of real property generally located at the southwest corner of the <br />intersection of Valley Boulevard and Pepper Street, in the City (APN 254-071-45) and <br />legally described in Exhibit "A-2" attached to this resolution and incorporated by reference <br />herein ("County Parcel"); and <br />WHEREAS, the City owns approximately 29,515 square feet of certain real <br />property consisting of excess right -or -way from the former alignment of Valley Boulevard, <br />which is adjacent to the Developer Parcel and the County Parcel and is generally located at <br />the southwest comer of intersection of Valley Boulevard and Pepper Street, in the City and <br />legally described in Exhibit "A-3" attached to this resolution and incorporated by reference <br />herein (the "City Property"); and <br />WHEREAS, the City is in the process of obtaining an agreement of the County to <br />sell the County Parcel to the City through a separate purchase and sale agreement with the <br />County; and <br />WHEREAS, the Developer desires to acquire and redevelop the County Parcel, <br />the City Property (collectively, the "County/City Property") and the Developer Parcel as a <br />full service vehicle fueling station, convenience store, quick service restaurant, car wash <br />facility and approximately 6,600 square feet of retail space by entering into a DDA with the <br />City (the "Project"); and <br />WHEREAS, an aerial depiction of the County/City Property and the Developer <br />Parcel is attached to this resolution as Exhibit "A-4" and incorporated by reference herein; <br />and <br />
