I RESOLUTION NO. R-100-15 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, CALIFORNIA, APPROVING THE RECORDING OF A QUITCLAIM DEED 3 TO REMOVE AN AGREEMENT TO CONSTRUCT OFF-SITE 4 IMPROVEMENTS FOR ASSESSORS PARCELS 0260-072-02,03, 04 5 WHEREAS, the City of Colton recorded an Agreement to Construct Off -Site 6 Improvements ("Agreement") on Assessor's Parcels 0260-072-02, 03 and 04 ("Property") on May 8, 1986; and 7 WHEREAS, the Property is fully entitled for construction of an 808,000 square foot 8 industrial building and the recorded Agreement duplicates the requirements of the 9 Conditions of Approval to develop the Property; and 10 WHEREAS, the City finds that Resolution R-22-13, approved on November 26, 2013 by the Planning Commission, require the off-site improvements to be constructed as I I required by the recorded 1986 Agreement. 12 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of 13 Colton, as follows: 14 SECTION 1. The recitals and findings preceding this Resolution are true and correct IS and are incorporated into this Resolution by this reference. 16 SECTION 2. The 1986 recorded Agreement to Construct Off -Site Improvements is superseded by the Conditions of Approval in Planning Commission Resolution R-22-13, 17 which require the construction of the off-site improvements. 18 SECTION 3. This action is Exempt pursuant to California Environmental Quality Act (CEQA) Section 15061(b)(3) due to the certainty that there is no possibility that the 19 action will have a significant effect on the environment. 20 SECTION 4. The City Clerk shall certify to the adoption of this Resolution.
