1 <br />2 RESOLUTION NO. R-77-11 <br />3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF COLTON ADOPTING CHANGES TO THE TERMS <br />4 AND CONDITIONS OF EMPLOYMENT OF EMPLOYEES <br />5 IN THE WATER/WASTEWATER BARGAINING UNIT <br />REPRESENTED BY THE INTERNATIONAL <br />6 BROTHERHOOD OF ELECTRICAL WORKERS, LOCAL <br />47 <br />7 <br />8 WHEREAS, the City of Colton ("City") has met and conferred with the International <br />9 Brotherhood of Electrical Workers Union, Local 47 ("Union") in an attempt to negotiate a <br />10 successor to the Memorandum of Understanding covering the Water/Wastewater Bargaining <br />11 Unit employees, which expired on June 30, 2011; and <br />12 <br />WHEREAS, the City and the Union have exhausted all reasonable avenues by which <br />13 <br />14 to negotiate a successor Memorandum of Understanding; and <br />15 WHEREAS, despite participating in good faith negotiations, the City and the Union <br />16 are unable to reach agreement on a successor Memorandum of Understanding and have <br />17 reached an impasse in the meet and confer process; and <br />18 <br />WHEREAS, the City and the Union have been unable to resolve this impasse or agree <br />19 <br />20 upon an impasse resolution procedure, and in accordance with Administrative Policy Number <br />21 4.03.100, Section 18, the matter has been referred to the City Council for resolution; and <br />22 WHEREAS, the City Council has considered the matter and has decided to implement <br />23 certain terms and conditions of employment that were included in the City's last, best, and <br />24 <br />final offer to the Unit. <br />25 <br />26 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of <br />27 Colton does hereby adopt changes to the terms and conditions of employment for <br />Water/Wastewater Bargaining Unit employees represented by the International Brotherhood of <br />28 Electrical Workers, Local 47 ("Bargaining Unit Employees") as follows: <br />
