R-101-11 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON, CALIFORNIA, APPROVING THAT CERTAIN <br />EXCLUSIVE NEGOTIATION AGREEMENT (EAGLE COLTON 55 <br />LLC: SENIOR CITIZEN AFFORDABLE HOUSING PROJECT) <br />WITH EAGLE COLTON 55 LLC <br />WHEREAS, the Redevelopment Agency for the City of Colton ("Agency") is a <br />community redevelopment agency established pursuant to the California Community <br />Redevelopment Law (Health and Safety Code § 33000 et seq.); and <br />WHEREAS, the Agency is the owner of certain real property ('Propert/, ') within <br />the City of Colton ("City"); and <br />WHEREAS, the City desires to provide for the development of the Property with <br />approximately one hundred (100) to one hundred fifty (150) units of affordable rental <br />housing available only to senior citizens ("Project"); and <br />WHEREAS, Eagle Colton 55 LLC, a Delaware limited liability company <br />("Developer"), is in the business of developing and managing safe, decent and affordable <br />rental and ownership housing in California; and <br />WHEREAS, the City and the Developer desire to negotiate with each other <br />regarding the potential terms and conditions of a future agreement ("DDA") between the <br />City and the Developer for the Developer to develop the Project on the Property; <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON, <br />CALIFORNIA, DOES HEREBY RESOLVE: <br />SECTION 1. Recitals. The City Council finds and determines that the recitals of <br />facts preceding this Resolution are true and correct and such recitals are incorporated into <br />this Resolution by this reference. <br />SECTION 2. CEQA Compliance. The approvals given in this Resolution do not <br />commit the City to any action that may have a significant effect on the environment. As a <br />result, such approvals do not constitute a project subject to the requirements of the <br />California Environmental Quality Act. <br />SECTION 3. Approval of Exclusive Negotiation Agreement. The City Council <br />hereby approves that certain Exclusive Negotiation Agreement (Eagle Colton 55 LLC: <br />Senior Citizen Affordable Housing Project), in substantially the form attached to this <br />Resolution as Exhibit "A." <br />SECTION 4. Implementation. The City Council hereby authorizes and directs the <br />City Manager to sign and enter into the Exclusive Negotiation Agreement (Eagle Colton 55 <br />LLC: Senior Citizen Affordable Housing Project) on behalf of the City and take any action <br />23152.06025\7041209.2 <br />
