Kenny, Director of Parks, Recreation & Family Services <br />SUBJECT: <br />Resolution Ordering the Levy and Collection of Assessments <br />Within the Landscape and Lighting Maintenance District No. 1 <br />(LLMD No. 1) <br />DATE: June 7, 2000 <br />BACKGROUND: <br />This is the annual Public Hearing for the Levy of Assessments pursuant to provisions of the Streets and <br />Highways Code, Landscape and Lighting Act of 1972. The City Council, after preliminary review of the <br />Engineer's Report, is required to approve the final report, along with the summary of assessments for the <br />2000/2001 annual tax levy for LLMD No. 1. <br />DISCUSSION/ANALYSIS: <br />The District provides maintenance, service and operation of landscape and lighting improvements and <br />associated appurtenances located within the public right-of-way and dedicated landscape easements, which are <br />throughout the City. As stated above, the District includes five (5) distinct Zones. Each Zone has specific <br />improvements and services that provide special and direct benefit to the parcels within the Zones. The costs <br />associated with the improvements are equitably spread between all benefiting parcels within the Zones. Only <br />parcels that receive direct benefit from the improvements are assessed. <br />FINANCIAL IMPACT: <br />The method of assessment spread is based on equivalent dwelling units (EDU) per parcel. Pursuant to the Act, <br />the costs of the District may be apportioned by any formula or method that fairly distributes the net amount to be <br />assessed. The formula used for each Zone reflects the composition of the parcels, and the improvements are <br />service provided to fairly proportion the costs. The proposed assessments for 2000/2001 are unchanged from <br />those levied for Fiscal Year 1999-2000 and accounted for in Fund 702. <br />Fiscal year 1999/2000 audited beginning fund balance is $438,867. For the current fiscal year there is a need to <br />increase the budgeted appropriations by $105,000 primarily due to professional services, (702-6200-6210-2350), <br />being under budgeted and the higher—than-projected use of plant materials, (702-6200-6210-2301). State law <br />requires special districts to maintain a fund balance of less than $300,000 and staff is recommending Council <br />approval of an additional appropriation of $42,887 for fiscal year 2000/2001. These funds are to be appropriated <br />as follows: (702-6200-6210-4910), $30,000 for a vehicle and trailer, (702-6200-6210-4930), $8,600 for small <br />equipment and (702-6200-6210-2250), $4,300 for plants, shrubs, etc. These increased appropriations will <br />reduce the fund balance below the maximum $300,000 level and increase the service levels in the five district <br />zones. <br />ENVIRONMENTAL IMPACT: <br />None. <br />RECOMMENDATION: <br />Staff recommends that Council open the Public Hearing and accept testimony. Close the Public Hearing, accept <br />the final Engineer's Report, adopt the Resolution ordering the levy and collection of assessments for the City of <br />Colton 2000/2001 Landscape and Lighting Maintenance District No. 1 and approve the capital outlay budget. <br />Attachment: Resolution <br />Engineer's Report <br />Capital Outlay Budget <br />Item #2 <br />
