CLARKE, UTILITY DIRECTO 1 7 � <br />SUBJECT: ADOPT THE ATTACHED RESOLUTION TO DECLARE THAT EMERGENCY <br />CONDITIONS EXIST IN THE SEWER LINE ON WESTERN AVENUE, AND <br />DELEGATING AUTHORITY TO THE UTILITY DIRECTOR TO ORDER <br />ACTIONS REQUIRED AND NEGOTIATE THE REQUIRED REPAIRS IN <br />AN AMOUNT NOT -TO -EXCEED $31,000 FOR THE REPAIRS TO BE <br />MADE TO THE SEWER LINE <br />DATE: JUNE 12, 2000 <br />BACKGROUND: <br />Each fiscal year, the Wastewater Department obtains a term purchase order for minor repairs <br />to sewer mains, laterals and manholes. The purchase order repairs cannot exceed $5,000. <br />DISCUSSION/ANALYSIS: <br />Emergency sewer line repairs on Western Avenue, south of Colton Avenue are required <br />because of a risk of having the street collapse due to the sewer line failure, however, the <br />estimated amount exceeds the dollar amount allowed on a term purchase order. <br />Section 22050 of the Public Contract Code allows the Council to pass a resolution by a four- <br />fifths vote of its membership declaring that emergency conditions existed and delegating <br />authority to order actions required by that emergency without giving notice for bids to let <br />contracts. <br />ENVIRONMENTAL IMPACT: <br />None <br />FINANCIAL IMPACT: <br />The FY99-00 Wastewater Budget included sufficient funds in the Emergency, Unscheduled <br />Sewer Line repairs in Account No. 522-8200-8200-2303 to cover the costs of the repairs. <br />RECOMMENDATION: <br />Staff recommends that Council adopt the attached Resolution Declaring Emergency <br />Conditions at the locations stated above, delegating authority to the Utility Director to order <br />actions required, to negotiate the required repairs in an amount not -to -exceed $31,000 for the <br />repairs to be made to the sewer line. <br />Report Prepared By: Lorraine June <br />CCWr&r99WffkWS#2 <br />Item #17 <br />
