1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />ORDINANCE NO. 0-05-02 <br />AN ORDINANCE OF THE CITY OF COLTON <br />AMENDING SECTIONS 7.08.100 AND 7.08.150 <br />OF THE COLTON MUNICIPAL CODE AND <br />ADDING CHAPTER 7.10 OF TITLE 7 OF THE <br />COLTON MUNICIPAL CODE REGARDING <br />VICIOUS DOGS <br />WHEREAS, the City of Colton ("City") is authorized pursuant to Article 7, Section I I of the <br />ICalifornia Constitution to "make and enforce within its limits all local, police, sanitary, and other <br />Iordinances and regulations not in conflict with general laws ", including the regulation of animals; <br />I and <br />WHEREAS, the City is authorized pursuant to Food and Agriculture Code Sections 31621 <br />and 31683 to adopt and administer an administrative procedure for the regulation and prohibition of <br />potentially dangerous and vicious dogs; and <br />WHEREAS, the City is further authorized by Government Code Section 36901 to impose <br />I fines, penalties, and forfeitures for violations of the City's ordinances; and <br />WHEREAS, the City Council of the City of Colton hereby finds and declares all of the <br />I following: <br />(a) Potentially dangerous and vicious dogs have become a serious and widespread threat <br />Ito the safety and welfare of citizens of this City. In recent years, they have assaulted without <br />provocation and seriously injured numerous individuals, particularly children, and have killed <br />numerous dogs. Many of these attacks have occurred in public places. <br />(b) The number and severity of these attacks are attributable to the failure of owners and <br />keepers of dogs to register, confine, and properly control vicious and potentially dangerous dogs. <br />(c) The necessity for the regulation and control of vicious and potentially dangerous dogs <br />is a serious problem, requiring swift reaction by the City, and existing laws are inadequate to deal <br />with the threat to public health and safety posed by vicious and potentially dangerous dogs. <br />FOLLOWS: <br />RVPUB\JSB\630393 <br />THE CITY COUNCIL OF THE CITY OF COLTON DOES ORDAIN AS <br />-I- <br />
