R-07-93 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON <br />SUPPORTING LEGISLATION TO ELIMINATE UNFUNDED FEDERAL MANDATES <br />WHEREAS, The City of Colton is facing accelerated costs due to unfunded federal <br />mandates; and <br />WHEREAS, Congressman Gary A. Condit, as a committee member of the Committee <br />on Government Operations, which has jurisdiction over federal mandates, is supporting <br />legislation to eliminate unfunded federal mandates; and <br />WHEREAS, unfunded federal mandates on State and Local governments have become <br />increasingly extensive in recent years; and <br />WHEREAS, such mandates have, in many instances, added to growing deficits in <br />State and Local budgets and have resulted in the need for Local governments, such as the <br />City of Colton, to increase revenue or curtail services; and <br />WHEREAS, federal mandates such as Safe Drinking Water Act, NPDES Wastewater <br />Discharge, Industrial Waste Pretreatment, Federal Sludge Disposal Regulations, NPDES <br />Stormwater Regulations and many more continue to mount mandated costs on underfunded <br />local governments such as the City of Colton; and <br />WHEREAS, Congressman Gary A. Condit (D -CA) will introduce legislation to assure <br />that the federal government pays the total amount of direct costs incurred by State and Local <br />governments in complying with certain requirements which take effect on or after the date <br />of enactment of the Act under a Federal statute or regulation; and <br />WHEREAS, this legislation will be introduced at the beginning of the 103rd <br />Congress; and <br />WHEREAS, this legislation would provide that any requirement under a Federal <br />statute or regulation that a State or local government conduct an activity (including a <br />requirement that a government meet national standards in providing a service) shall apply <br />to the government only if all funds necessary to pay the direct costs incurred by the <br />government in conducting the activity are provided by the Federal Government ; and <br />WHEREAS, the City of Colton has experienced an increase from $1.8 to $2.0 million <br />in operating costs annually, and a requirement for $26.0 million in construction costs <br />pending as federal mandated costs with more still to come; and <br />
