R-09-93 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF COLTON AUTHORIZING PERSONNEL ACCESS TO THE <br />CRIMINAL HISTORY INFORMATION NEEDED TO <br />EVALUATE PROSPECTIVE APPLICANTS FOR EMPLOYMENT <br />BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF <br />Me) 14061zf:TZ0a[01at141:�f <br />WHEREAS, Penal Code Sections 11105(b) (10) and 1300 (b) (10) <br />authorize cities, counties, and districts to access state and local <br />summary criminal history information for employment; and <br />WHEREAS, Penal Code Sections 11105(b) (10) and 1300 (b) (10) <br />require that there be a requirement or exclusion from employment, <br />based on specific criminal conduct on the part of the subject of <br />record; and <br />WHEREAS, Penal Code Sections 11105(b) (10) and 1300 (b) (10) <br />require the city council to specifically authorize access to <br />summary criminal history information for employment; <br />NOW, THEREFORE, BE IT RESOLVED that: <br />1. The City shall not consider a person who has been <br />convicted of a felony or a misdemeanor involving moral turpitude <br />eligible for employment, except that such conviction may be <br />disregarded if it is determined that mitigating circumstances <br />exist, or that the conviction is not related to the employment in <br />question. <br />2. A prospective employee who is being recommended for <br />employment or an employee who is recommended for promotion or <br />transfer to another department or position shall be fingerprinted <br />by the Police Department at the request of the Personnel Director. <br />
