R-112-93 <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF COLTON DECLARING INTENT TO <br />WITHDRAW FROM SAN BERNARDINO COUNTY'S <br />JOINT POWERS AGREEMENT -EAST VALLEY <br />PLANNING AGENCY, PURSUANT TO AMENDED <br />SECTION 21670(b) OF THE PUBLIC <br />UTILITIES CODE <br />WHEREAS, Public Utilities Code Section 21670 et seq. pro- <br />vides for the establishment of an airport land use commission in <br />every county in which there is located an airport which is <br />served by a scheduled airline; and, <br />WHEREAS, prior to passage of Senate Bill 443 (enacted and <br />effective June 30, 1993), Section 21670(b) of the Public <br />Utilities Code provided that each county "shall" establish a <br />commission in such circumstances; and, <br />WHEREAS, the City of Colton has been a member of the East <br />Valley Planning Agency Airport Land Use Commission created in <br />the County of San Bernardino pursuant to the joint powers agree- <br />ment signed by the County and the City of Colton; and, <br />WHEREAS, Senate Bill 443 amended Section 21670(b) to change <br />the term "shall" to "may" in order to relieve local entities such <br />as the County of the duty to incur unnecessary expenses in <br />certain aspects of airport land use; and, <br />WHEREAS, the State of California will no longer reimburse <br />San Bernardino County for administration of the Airport Land Use <br />Commission program should it be continued; and, <br />WHEREAS, airport safety reviews are performed and will con- <br />tinue to be performed for all affected development proposals <br />within San Bernardino County in accordance with the adopted <br />General Plan policies and Development Code standards in order to <br />protect public health and safety; and, <br />WHEREAS, elimination of the ALUC program will reduce fees, <br />eliminate redundant reviews, streamline processes; and, <br />WHEREAS, the City of Colton concurs that continued unreim- <br />bursed County administration of the ALUC program would be cost <br />prohibitive to the County and not in the best interests of all <br />concerned. <br />THEREFORE, BE IT RESOLVED, that the Mayor and Council of <br />the City of Colton do hereby declare their intent to withdraw <br />from the Joint Powers Agreement -East Valley Planning Agency <br />Airport Land Use Commission. <br />APPROVED and ADOPTED this 26th day of October, 1993. <br />ATTEST: /1 <br />HELEN A.
