R-05_ 96 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON, REQUESTING THE LOCAL AGENCY FORMATION <br />COMMISSION (LAFCO) TO COMMENCE PROCEEDINGS FOR THE <br />ANNEXATION OF THE AREA KNOWN AS THE RETENTION BASIN <br />PROPERTY AT THE END OF PRADO LANE, IN THE COUNTY OF <br />SAN BERNARDINO, COLTON SPHERE OF INFLUENCE. <br />WHEREAS, the City of Colton desires to initiate proceedings <br />pursuant to the Cortese -Knox Local Government Reorganization Act of <br />1985, commencing with Section 56000 of the California Government <br />Code, for The Retention Basin Property at the end of Prado Lane <br />annexation; and <br />WHEREAS, notice of intent to adopt this Resolution of <br />Application has been given to each interested and each subject <br />agency; and <br />WHEREAS, the territory proposed to be annexed is uninhabited <br />and a description of the boundaries of the territory is set forth in Exhibit <br />"A" attached hereto and by this reference incorporated herein; and <br />WHEREAS, it is desired that the proposed annexation be <br />subject to the following terms and conditions: <br />• That the entire area within the Colton Sphere of Influence be <br />annexed -,and <br />WHEREAS, the reason for the proposed annexation is as <br />follows: the City of Colton wishes to obtain an exempt status from the <br />County Tax Collector's Office. <br />WHEREAS, this Council recognizes that the proposal must still <br />be scrutinized under the California Environmental Quality Act (CEQA). <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of <br />the City of Colton hereby adopts this Resolution of Application, and the Local <br />Agency Formation Commission of San Bernardino County is hereby <br />requested to commence proceedings for the annexation of territory as <br />
