1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 23 24 25 26 27 28 RESOLUTION No. R-102-01 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A SPECIAL MUNICIPAL ELECTION TO BE CONSOLIDATED WITH THE MARCH PRIMARY ON TUESDAY, MARCH 51 2002, TO FILL THE UNEXPIRED TERM OF THE ELECTED POSITION OF CITY COUNCILMEMBER DISTRICT 1 WHEREAS, under the provisions of the laws relating to General Law Cities in the State of California, a Special Municipal Election shall be held on the next regularly established election date, Tuesday, March 5, 2002, for the election of a Municipal Officer, to wit, City Councilmember, District 1; and, WHEREAS, the City of Colton has determined through its electorate that the position of the City Council, District 1, shall be an elected position; and, WHEREAS, the duly elected incumbent vacated the office effective October 2, 2001, leaving vacant the office of City Council, District 1, with an unexpired term; and, WHEREAS, Government Code Section 36512(b) provides that "If a vacancy occurs in an elective office provided for in this chapter, the council shall, within 30 days from the commencement of the vacancy, either fill the vacancy by appointment or call a special election to fill the vacancy. The special election shall be held on the next regularly established election date not less than 114 days from the call of the special election...." This section further provides that the person appointed or elected to fill said vacancy holds office for the unexpired term of the former incumbent. WHEREAS, in the course of conduct of the election it is necessary for the City of Colton to request services of the County of San Bernardino; and, 1
