1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />RESOLUTION No. R-102-01 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF COLTON, CALIFORNIA, CALLING AND GIVING <br />NOTICE OF THE HOLDING OF A SPECIAL MUNICIPAL <br />ELECTION TO BE CONSOLIDATED WITH THE MARCH <br />PRIMARY ON TUESDAY, MARCH 51 2002, TO FILL THE <br />UNEXPIRED TERM OF THE ELECTED POSITION OF <br />CITY COUNCILMEMBER DISTRICT 1 <br />WHEREAS, under the provisions of the laws relating to General Law Cities in <br />the State of California, a Special Municipal Election shall be held on the next regularly <br />established election date, Tuesday, March 5, 2002, for the election of a Municipal <br />Officer, to wit, City Councilmember, District 1; and, <br />WHEREAS, the City of Colton has determined through its electorate that the <br />position of the City Council, District 1, shall be an elected position; and, <br />WHEREAS, the duly elected incumbent vacated the office effective October <br />2, 2001, leaving vacant the office of City Council, District 1, with an unexpired term; <br />and, <br />WHEREAS, Government Code Section 36512(b) provides that "If a vacancy <br />occurs in an elective office provided for in this chapter, the council shall, within 30 <br />days from the commencement of the vacancy, either fill the vacancy by appointment <br />or call a special election to fill the vacancy. The special election shall be held on the <br />next regularly established election date not less than 114 days from the call of the <br />special election...." This section further provides that the person appointed or elected <br />to fill said vacancy holds office for the unexpired term of the former incumbent. <br />WHEREAS, in the course of conduct of the election it is necessary for the City <br />of Colton to request services of the County of San Bernardino; and, <br />1 <br />
