1 ORDINANCE NO. 0-01-23 <br /> 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLTON, <br /> 3 CALIFORNIA, AMEND CERTAIN SECTIONS IN CHAPTERS 18.04; 18.06; <br /> 18.24, 18.26, 18.28, AND 18.48 OF TITLE 18 (ZONING) OF THE COLTON <br /> 4 MUNICIPAL CODE RELATED TO DEFINITIONS, PERMITTED USES, <br /> DEVELOPMENT STANDARDS IN THE I-P (INDUSTRIAL PARK), M-1 <br /> 5 (LIGHT INDUSTRIAL) AND M-2 (HEAVY INDUSTRIAL) ZONES, AND <br /> 6 SPECIAL PROVISIONS (FILE INDEX NO. DAP-001-697) <br /> 7 WHEREAS, on March 22, 2022, the Planning Commission of the City of Colton <br /> ("Planning Commission") conducted a duly noticed public hearing and recommended the City <br /> 8 Council of the City of Colton ("City Council") amend Title 18 of the Colton Municipal Code <br /> 9 (the "Municipal Code"). Following the conclusion of said hearing, the Planning Commission <br /> adopted their Resolution No. R-01-22, recommending approval to the City Council to amend <br /> 10 ("Zoning Text Amendment") Chapters 18.04; 18.06; 18.24, 18.26, 18.28, and 18.48 of Title 18 <br /> of the Colton Municipal Code; and <br /> 11 <br /> WHEREAS, the City Council has determined that the Zoning Text Amendment is <br /> 12 consistent with the City of Colton General Plan("General Plan") as indicated below; and <br /> 1 3 WHEREAS, the City Council has determined that the proposed Zoning Text <br /> 14 Amendment is in the best interests of the City, and that it would be in the public interest to <br /> approve the Zone Text Amendment; and <br /> 15 WHEREAS, the City Council appointed Warehouse Moratorium Ad-Hoc Committee <br /> 1 6 met four times to discuss, review and provide direction to staff in the crafting of the zoning text <br /> amendment taking into account comments received from the public outreach efforts made by the <br /> 17 City; <br /> WHEREAS, the City Staff met held three public outreach meetings with industrial <br /> 18 sector representatives and community meetings with Colton residents and interested parties. <br /> 19 The Ad-Hoc Committee and staff considered and included many of the comments received in <br /> the proposed ordinance; <br /> 20 <br /> WHEREAS, the Zoning Text Amendment was reviewed, studied and found exempt <br /> 21 from the California Environmental Quality Act("CEQA")as more fully described below; and <br /> 22 WHEREAS, on February 7, 2023 the City Council held a duly noticed public hearing at <br /> which persons wishing to testify in connection with the Zoning Text Amendment were heard <br /> 23 and the Zoning Text Amendment was comprehensively reviewed. <br /> 24 <br /> WHEREAS, all other legal prerequisites to the adoption of this Ordinance have <br /> 75 occurred. <br /> 26 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON DOES <br /> 27 ORDAIN AS FOLLOWS: <br /> 28 SECTION 1.
