CITY OF COLTON <br />AGENDA REPORT <br />For the Council Meeting of June 5, 2001 <br />TO: Honorable Mayor & City Council <br />FROM: Ronald C. Kenny, Director of Parks, Recreation and <br />Family Services <br />SUBJECT: Three Resolutions, 1.) Resolution Initiating <br />Proceedings, 2.) Preliminary Approval of the <br />Engineer's Report, and 3.) Resolution of Intent for the <br />2001-2002 Fiscal Year Assessment Levy of the City <br />Wide Landscape and Lighting Maintenance District <br />No. 1, Fiscal Year 2001-2002 and Declaring Intention of <br />a Public Hearing Regarding the L.L.M.D. for June 19, <br />2001 <br />DATE: May 22, 2001 <br />BACKGROUND: <br />The City Council previously formed a Landscape and Lighting Maintenance Assessment <br />district. This formation was accomplished pursuant to the provisions for Landscaping <br />and Lighting Act of 1972, Part 2 of Division 15 of the Streets and Highways Code of <br />California. This Act provides for the levy and collection of assessments by the County of <br />San Bernardino for the City of Colton to pay the maintenance and services of lighting, <br />landscaping, and all appurtenant facilities and operations related to the L.L.M.D. No. 1. <br />The L.L.M.D. consists of 8 Zones, of which five (5) Zones have an annual levy. The <br />benefit Zones are Cooley ranch (Zone 1), La Loma Hills (Zone 3), Old Colton (Zone 4), <br />Reche Canyon (Zone 5) and West Valley (Zone 8). The improvements within the District <br />include; turf, ground cover, street trees, irrigation systems, perimeter landscaping, <br />slopes, open space, lighting systems and all necessary appurtenances. The costs <br />associated with the improvements are equitably spread between all benefiting parcels <br />within the Zones. Only parcels that receive direct benefit from the improvements are <br />assessed. <br />DISCUSSION/ANALYSIS: <br />Prior to a Public Hearing the Act requires that certain resolutions be adopted. The <br />required resolutions are Initiating Proceedings for the Annual Levy of Assessments, <br />Declaring Intention to Levy the Annual Assessment and Preliminary Approval of the <br />Annual Levy Report, prepared by Muni Financial, Inc., the Landscape Maintenance <br />District Engineers. <br />item #15 <br />LLMD Agenda 05/29/01 <br />
