ITEM #7 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF May 16, 2006 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: KENNETH RULON, CHIEF OF POLICE <br />SUBJECT: AMENDMENT TO THE FRANCHISE TOW AGREEMENTS BETWEEN <br />THE CITY OF COLTON AND PEPE'S TOWING, PATRIOT TOWING, <br />AND SOUTH STATE TOWING <br />DATE: May 9, 2006 <br />BACKGROUND: <br />The Police Department currently has Franchise Tow Agreements with three local towing vendors, <br />in accordance with Chapter 10.40 of the Colton Municipal Code and the City's Towing Rules and <br />Specifications for Non -Consensual Towing Services. With the addition of the Police Department's <br />Impound Yard, it is necessary to amend the current agreements to allow for certain vehicles to be <br />towed to the new impound yard. The proposed amendments to the three franchise agreements <br />are attached hereto for your reference. <br />DISCUSSION / ANALYSIS: <br />The Impound Yard is scheduled to be open and operational by May 22, 2006. As such, it is <br />necessary to amend the current Franchise Tow Agreements with the authorized towing vendors. <br />The amendments allow for the towing vendors to tow vehicles to the Police Department's <br />Impound Yard. Furthermore, the amendments provide a procedure for the vendors to apply <br />towing fees against their monthly franchise fee. All towing fees will be applied directly to each <br />individual vehicle's towing and storage fees. Such towing fees will be applied at the same rate as <br />billed by the towing vendors. <br />FINANCIAL IMPACT: <br />The financial impact due to towing fees is anticipated to be cost neutral, since the cost will be <br />"passed through" and applied to the aggregate towing and storage bill. The bill will be paid by the <br />vehicle owner prior the vehicle's release. In the event the vehicle owner does not claim the <br />vehicle, the tow fees will be provided by the proceeds of the lien sale of the vehicle. <br />ENVIRONMENTAL IMPACT: <br />None. <br />
