2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />ORDINANCE NO.O-12-24 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLTON <br />APPROVING AN AMENDMENT TO THE RECHE CANYON SPECIFIC <br />PLAN TO CHANGE THE LAND USE DESIGNATION FROM ESTATE <br />DENSITY (RESIDENTIAL) TO COMMERCIAL (FILE INDEX NO: DAP- <br />001-453) <br />WHEREAS, local governments are authorized by Government Code section 65350 et seg. <br />to prepare, adopt and amend general plans; and <br />WHEREAS, the proposed Specific Plan Amendment will change the land use designation <br />from Estate Density (Residential) to Commercial for property located at 2501 Reche Canyon Road <br />Assessor Parcel Numbers 0284-211-70, 71, 72; 1178-371-27; and <br />WHEREAS, the staff report accompanying this resolution is found to be true, adopted as <br />Findings and incorporated in this resolution; and <br />WHEREAS, the Specific Plan Amendment was reviewed, studied, and found to comply <br />with the California Environmental Quality Act ("CEQA"), as more fully described below; and <br />WHEREAS, on October 1 and October 15, 2024, the City Council of the City of Colton <br />("City Council") held a duly noticed public hearing at which time all persons wishing to testify in <br />connection with the application were heard and the application was fully examined. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF COLTON: <br />SECTION 1. Based on the entire record before the City Council of the City of Colton, all <br />written and oral evidence presented has been considered and reviewed, and the City Council finds <br />that the Specific Plan Amendment is consistent with State law and will promote the public health, <br />safety and welfare. <br />SECTION 2. The Specific Plan Amendment is consistent with the General Plan in its <br />entirety, but specifically Land Use Element Goal LU-1, LU-3, LU-9 and Policies LU-5.6, LU-9.3, <br />and LU-9.8 that pertain to commercial . <br />SECTION 3. The City Council of the City of Colton, in accordance with the California <br />Environmental Quality Act (CEQA), has found, on the basis of a Project Environmental Impact <br />Report (EIR) prepared to assess environmental impacts of the project that determined that the <br />project would not create unavoidable significant adverse impacts on the environment (i.e., air <br />quality, traffic, and public services (parks). Because there are no unavoidable significant adverse <br />impacts on the environment a Statement of Overriding Considerations is not applicable for this <br />project. However, the project includes Table I.D. organized with a summary of the project impacts, <br />mitigation measures, and the level of significance of each impact following the application of <br />identified mitigation measures as adopted by the City Council in Resolution No. R-93-24. <br />SECTION 4. Based upon the findings set forth in Sections 1 and 2 of this Resolution, the <br />City Council hereby approves the Specific Plan Amendment as presented and as defined in Exhibit <br />A attached to this resolution. <br />
