ITEM #4 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF March 20, 2007 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: COMMUNITY DEVELOPMENT AND CITY ATTORNEY <br />SUBJECT: APPROVAL OF EXTENSION OF URGENCY ORDINANCE NO. 0-11- <br />06 ENACTING FOR A PERIOD OF ONE (1) YEAR A MORATORIUM <br />ON THE APPROVAL OF APPLICATIONS FOR CERTAIN LAND USES <br />CITY-WIDE <br />DATE: March 8, 2007 <br />BACKGROUND: <br />On March 21, 2006, the City Council adopted Urgency Ordinance No. 0-08-06, enacting a 45 -day <br />moratorium on the approval of applications for certain land uses city-wide (the "Moratorium <br />Ordinance") in order to protect the public health, safety and welfare. These land uses include the <br />following: animal boarding, automobile storage, mini warehouses, nightclubs, private bus <br />terminals, tattoo/body piercing, tobacco/hookah bars, marijuana dispensaries and swap meets. <br />On April 18, 2006, the City Council received and filed a report describing the measures taken to <br />alleviate the condition which led to the adoption of the Moratorium Ordinance, pursuant to <br />California Government Code section 65858. These measures include the City Council exempting <br />from the Moratorium Ordinance all applications currently on file and City Executive Staff working <br />with the City's General Plan consultants to address appropriate land use designations as part of <br />the revisions to the General Plan. <br />On May 5, 2006, the City Council adopted Urgency Ordinance No. 0-11-06, extending the <br />Moratorium Ordinance for an additional 10 months and 15 days. This Urgency Ordinance is set to <br />expire March 20, 2007. <br />Pursuant to California Government Code Section 65858(d), on March 6, 2007, a report of the <br />measures taken thus far to alleviate the condition which led to the adopting of the Moratorium <br />Ordinance was approved by the City Council and made available to the public. The report is <br />attached hereto as Attachment "B". <br />Government Code section 65858 also allows the City Council to extend the Moratorium Ordinance <br />one more time, for a period of one year, by holding another public hearing. Only two (2) <br />extensions of the Moratorium Ordinance may be adopted. <br />
