CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF April 3, 2007 <br />TO: Honorable Mayor and City Council Members <br />FROM: Bill Smith, Community Services Director <br />SUBJECT: Request Approval of Amended Joint Use Agreement with the <br />Colton Joint Unified School District for the Use of the East Lower <br />Field Park Facilities at McKinley Elementary School and <br />Authorization of the City Manager to Sign Documents to Execute <br />Said Agreement <br />DATE: March 21, 2007 <br />ITEM #10 <br />BACKGROUND: <br />There is currently a Joint Use Agreement (JUA) in effect, between the City of Colton and the <br />Colton Joint Unified School District, for the use of the lower field park area at McKinley Elementary <br />School. The agreement sets forth responsibilities for maintenance, and sets hours of operation <br />for school activities and park activities. The City has invested a great deal of funding into this park <br />facility in recent years, installing 3 tee -ball baseball fields, which serve as the home of Colton Tee - <br />Ball, multiple picnic shelters and benches, and a children's play area. The current agreement <br />functions well, although the term of the current agreement is a "year to year' arrangement that <br />may be cancelled at the conclusion of any school year. <br />DISCUSSION/ANALYSIS: <br />The City would like to invest additional monies at McKinley Park, specifically to make needed <br />Americans with Disabilities Act (ADA) improvements at the site. Prior to allocating additional <br />funding to the site however, the City has asked the School District for a longer-term agreement to <br />ensure that these funds will benefit Colton's residents into future years. The School District has <br />consented to an extended agreement, and the attached, amended agreement was approved by <br />the School Board at their meeting of March 22, 2007. This agreement calls for an initial 5 -year <br />term, followed by renewable, successive 5 -year terms. The remainder of the agreement <br />conditions and terms remain essentially unchanged. <br />FINANCIAL IMPACT: <br />None <br />ENVIRONMENTAL IMPACT: <br />None <br />CONFLICT OF INTEREST: <br />None <br />
