CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF JUNE 19, 2007 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: Daryl Parrish, City Manager <br />SUBJECT: Approve and Adopt the Revised Executive Memorandum of <br />Understanding (MOU) and Allow Staff to Sign Said MOU and <br />Approve and Adopt the Amended Resolution R-47-07 for the <br />Executive Unit <br />DATE: June 11, 2007 <br />ITEM #12 <br />BACKGROUND: <br />During the last two years, the average Department Directors' salaries have fallen in comparison to <br />other agencies. To correct this, staff conducted a salary survey and presented the results to the <br />Honorable Mayor and Council in Closed Session on June 5, 2007. In addition, the Memorandum <br />of Understanding is being presented to the Council for non -monetary revisions. <br />DISCUSSION/ANALYSIS: <br />The attached resolution reflects the salaries for the Department Directors effective July 1, 2007. <br />The agencies surveyed to determine the salaries were; Azusa, Banning, Chino, Fontana, Loma <br />Linda, Moreno Valley, Ontario, Redlands, Rialto, San Bernardino, Upland and Yucaipa. The <br />survey data does not include any pending increases for the agencies. <br />In addition, changes are being made to the Executive MOU to delete reference to the former <br />Police Chief. Specifically, the sections of the MOU being deleted: <br />• Article II, Section 6: Retiree Medical — Delete lifetime retiree medical provided to Ken Rulon <br />following ten (10) years of service with the city. <br />• Article II, Section 13: POST Certificate Pay (Applicable to Chief of Police Kenneth E. Rulon) <br />Delete the 13% POST Certificate pay allowed for Ken Rulon. <br />• Article III, Section 6: Uniforms - Delete reference to Ken Rulon and replace with Chief of <br />Police. <br />• Article III, Section 7: Equivalent Benefits — Delete provision provided to Ken Rulon for the <br />highest equivalent benefits provided to the Police Management Association or the Executive <br />Unit. <br />• Article IV, Section 4: Sick Leave for Executive Management Employees — Delete 96 hour <br />accrual of sick leave and 75% cash out upon termination or non -renewal provided to Ken <br />Rulon. This provision was approved in closed session by the City Council in January of 2005 <br />and omitted from the document. <br />Finally, a provision has been added (Article II, Section 13: Severance Pay) to clarify that there is a <br />maximum amount of 12 months or the unexpired term of an at -will employment agreement, <br />whichever is less, as provided by applicable law. <br />7/10/03 City Clerk's Office Cb <br />
