0
AGENDA REPORT
CITY OF COLTON
For City Council Meeting of
August 5, 1997
July 23, 1997
TO: MAYOR GAYTAN, CITY COUNCIL AND CITY MANAGER
FROM: Julie Hayward Biggs, City Attor ey
SUBJECT: Ballot Measure/City Manager Ordin nee
As requested by Councilmember Sanders, attached is a copy of the proposed City
Manager ordinance to be submitted to the electorate at the November 1997 election, together
with a copy of our current ordinance. While numerous changes have been made to the
ordinance throughout to conform our ordinance to current law and constitutional requirements,
the most significant changes are as follows:
1. The office of city manager has been clearly identified as an "at will"
position and that anyone appointed to that position serves at the pleasure of the City
Council, subject to the limitations of law relating to such employment.
2. The ordinance specifies that the City Council may enter into a contract
with its appointee for the position of City Manager. Under the current ordinance, no
contract is permitted. Instead, appointment is by resolution. A contract arrangement
allows the City greater flexibility in setting the terms and conditions of employment and
of termination.
3. The requirement for residence in the City of Colton has been eliminated
in accord with applicable law.
4. Councilmembers remain ineligible to serve as City Manager for one year
after leaving office.
5. Compensation for the City Manager may be set either by resolution or by
contract. Currently, it must be set by resolution.
6. Reimbursement for expenses remains a matter for Council approval as is
currently the requirement.
Item No. 24
