Garcia, City nager 1,�� <br />FROM: a i amor mm i y evelopment Director <br />SUBJECT: Approval of a Dance Permit for Godmother's Restaurant, located at <br />1089 South Mount Vernon Avenue, Colton <br />DATE: <br />July 26, 1999 <br />BACKGROUND: <br />Godmother's Italian Restaurant is located at 1089 South Mount Vernon Avenue in the City of <br />Colton. Ms. Shirlee Pedersen, owner, is requesting a dance permit per Chapter 5.32 of the <br />City's Municipal Code, Dances, Section 5.32.040, Permit — Application and Issuance. <br />DISCUSSION/ANALYSIS: <br />Ms. Pedersen is proposing to provide live karaoke entertainment and conduct public dances <br />each week, as part of on-going social events at this location. The dances will cater to patrons <br />21 years of age and above. The proposed hours of operation are daily, with dining and <br />entertainment, which may include dancing throughout the evening. Currently the applicant has <br />karaoke from approximately 8:00 p.m. until midnight, and on occasions, until 1:00 a.m., <br />Wednesday through Saturday. <br />The applicant is currently licensed to operate a full bar and restaurant (Type 47) by the <br />Alcoholic Beverage Control (ABC), and has been since July 1982 with no conditions from the <br />ABC. Although staff is in the process of amending the dance permitting procedures, the <br />applicant expressed a sense of urgency due to their leasing situation, and possible necessity to <br />relocate outside of the City. As part of the Conditions of Approval, the occupancy load limits, <br />previously established by the City's Fire Department, will be imposed. <br />Additionally, staff is proposing the following conditions: <br />• The applicant agrees to maintain a Type 47 license issued by the ABC. <br />• Applicant agrees to implement a designated driver program. <br />• Applicant agrees to prohibit "crowd surfing" and "mosh pits." <br />• Applicant agrees to a review of its compliance with the terms and conditions of this dance <br />permit six months after issuance. <br />ALTERNATIVES: <br />Not to approve the application and risk the loss of the existing business due to relocation <br />outside of the City. <br />Item #20 <br />
