La Cadena Dr. <br />Colton, CA 92324 <br />Dear Mr. Garcia and Mrs Carvalho: <br />As you know the controversial public issue of Abe Beltran's $30,000.00 legal costs is on the <br />agenda for the January 5, 1999 Council Meeting. One argument that has been raised is the <br />argument that Best, Best & Krieger (BB&K) advised Beltran that he could vote on matters affecting <br />Steward. I have been informed that this argument is unfounded. I write to you for clarification. <br />There seems to be a question in fact if Beltran failed to disclose that Steward owed him money and <br />was making payments on an outstanding note? And, the only information revealed by Beltran to <br />BB&K was that Beltran worked for a related company that Steward also had an interest in? <br />Additionally, I understand, the opinion letter that was given to Beltran says that it is based on the <br />representations of Beltran. Representations that failed to disclose a promissory note and payments <br />being made to Beltran by Steward. That $11,000 was paid a few days after the vote to approve <br />payment of $231,000 to Steward by the City on the metro -mall project. And, that was not disclosed <br />until the matter was referred to the DA. Is this true? <br />As our City Manager and City Attorney, it would be very helpful, in fact it is critical, that you are <br />prepared to respond with factual answers to the above questions of public concern and controversy <br />at Tuesday's meeting, and If possible sooner. <br />If not, the council should wait until after the hearing, when they can review the evidence and <br />testimony, before making a decision. What is the hurry?
