CITY OF COLTON Item #10 <br />AGENDA REPORT <br />FOR CITY COUNCIL MEETING OF DECEMBER 18,2001 <br />TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS <br />FROM: DILU DE ALWIS, FINANCE DIRECTOR DPK <br />SUBJECT: APPROVE A SOLE SOURCE CONTRACT FOR THE PURCHASE AND <br />INSTALLATION OF TWO ELECTRIC WINCHES FOR THE BASKETBALL <br />HOOPS AT THE COLTON COMMUNITY CENTER TO PORTER ATHLETIC <br />EQUIPMENT CO. IN THE AMOUNT OF $6,192. <br />DATE: DECEMBER 6,2001 <br />BACKGROUND <br />When the Colton Community Center was built there were two mechanical winches installed to raise and <br />lower the basketball hoops. Both these winches are broken. They are becoming a safety hazard and need <br />to be replaced. Staff is recommending they be replaced with electric winches. <br />DISCUSSION/ ANALYSI <br />Porter Athletic Equipment Co. is the manufacturer of all the athletic equipment in the Gymnasium at the <br />Colton Community Center. We are replacing a portion of the existing equipment that is manufactured by <br />Porter Athletic Equipment Co. Staff is recommending that we replace the manual winches with equipment <br />from the same manufacturer. <br />This is a contract for replacement basketball winches that will be permanently affixed to the building at the <br />Community Center; it falls under the statutes of the State of California, Public Contract Code. The Public <br />Contract Code states that a General Law City must advertise and let for bid all contracts for "Public Works" in <br />excess of $5,000. <br />There are certain, well-recognized exceptions to the competitive bidding requirements under the Public <br />Contract Code. One exception is where the nature of the subject of the contract is such that competitive <br />proposals would be unavailing or would not produce an advantage. This is especially true in cases where a <br />sole source exists for products or supplies that "uniquely" meet the needs of the City's specifications. In such <br />cases, a City Council may reasonably exercise its discretion in selecting such products or supplies and <br />determining that applicable competitive bidding requirements do not apply, since there would be no <br />competitive advantage to an open market purchase. Staff believes that competitive bidding would not apply <br />for this purchase even though the total purchase price is $6,192, since the unique nature of the product to be <br />installed wouild not invoke competitive bids. The form of agreement is attached for your review. <br />FINANCIAL IMPACT <br />The funds are available in the FY 2001-2002 budget to make this purchase in the Parks, Recreation & Family <br />Services Building and Grounds Maintenance account #100-6200-6200-2250. <br />
