FRASER, DIRECTOR OF WATER & WASTEWATER OPERATIONS <br />SUBJECT: SET A PUBLIC HEARING FOR JULY 16, 2002 TO ADOPT A RESOLUTION AMENDING THE BASIC <br />FEE FOR STORMWATER MANAGEMENT AND THE STORMWATER MANAGEMENT FEE <br />DATE: June 24, 2002 <br />BACKGROUND <br />In October 1990 the County of San Bernardino Flood Control District was issued a five-year NPDES <br />Stormwater Permit, with 16 incorporated cities as co -permittees. The second five-year permit took effect for <br />the period of October, 1995 to October, 2000, and a third permit is now in effect until October 2005. <br />DISCUSSION /ANALYSIS <br />There is no increase in the Basic Fee for Stormwater Management and the Stormwater Management Fee. <br />Landowners, who have not changed their property usage, will not receive an increase over previous four <br />years' fees. The proposed amendment affects only the vacant parcels that have been developed, or have <br />changed to a different designated land use group. The fees collected this year will fund FY03-04, which <br />includes the City's operational costs for street sweeping, storm drain cleaning, roadway maintenance and litter <br />control. <br />FISCAL IMPACT <br />The cost to the City's residential and commercial landowners is the same as previous years. The revenue is <br />used to fund the City's NPDES Stormwater Program, as mandated by Federal and State regulations. Without <br />the Stormwater Fees, the General Fund would have to cover the costs for the on-going Stormwater Program <br />(FY02-03 $640,570). <br />ENVIRONMENTAL IMPACT <br />The NPDES Stormwater Program is a part of the Federal Clean Water Act and is intended to improve the <br />Nation's waterways. Compliance with the NPDES Stormwater requirements is mandated by the Federal <br />Government and the State Regional Water Quality Control Board enforces the requirements. <br />RECOMMENDATION <br />Staff recommends that the Colton Utility Authority set a Public Hearing for July 16, 2002 to adopt a Resolution <br />Amending the Basic Fee for Stormwater Management and the Stormwater Management Fee as set by the <br />Colton Municipal Code, Chapter 14.01. <br />
