4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />Item #6 <br />ORDINANCE NO. 0-09-03 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />COLTON AMENDING EXHIBIT "A" AS REFERENCED IN <br />SECTION 13.16.25 OF THE COLTON MUNICIPAL CODE AND <br />DELETING SECTIONS 13.16.070, 13.16.080, 13.16.090 AND <br />13.16.100 OF THE COLTON MUNICIPAL CODE RELATING TO <br />SEWER SERVICE CHARGES <br />WHEREAS, the City Council of the City of Colton ("City Council") desires to revise its <br />current wastewater sewer service charges to provide sufficient revenue to operate and maintain the <br />City's wastewater sewer system and its attendant facilities; and <br />WHEREAS, the City Council has based the revised fees and charges on the report <br />("Report") attached hereto as Exhibits "B"documenting the estimated reasonable costs of providing <br />the wastewater sewer services to customers in the City of Colton; and <br />WHEREAS, the findings contained herein are based upon the Report commissioned <br />by the City documenting the estimated reasonable costs of providing the wastewater sewerservices <br />to customers in the City; and <br />WHEREAS, the City Council finds, with respect to the revenue derived from the <br />increased fees and charges, that (1) there is a reasonable relationship between the use of the fees <br />and charges increased herein and the services for which they are imposed and this relationship is <br />more fully documented in the Report; (2) the revenue derived from the increased fees and charges <br />does not exceed the amount necessary to provide the services; (3) the increased fees and charges <br />shall not be used for any other purpose than that for which the fees and charges are imposed; (4) <br />the increased fees and charges do not exceed the proportional cost of the services attributable to <br />each customer; (5) the increased fees and charges are not levied for general governmental <br />purposes; and <br />WHEREAS, the City Council has determined that the wastewater sewer charges are <br />imposed only as a condition of extending or initiating service upon the requestof the customer. The <br />charge is only charged upon persons requesting the service; an owner of property without sewer <br />service is not subject to the charge. The sewer charge is not imposed upon real property or upon <br />persons as an incident of property ownership, and is not calculated or developed on the basis of any <br />parcel map, including an assessor's parcel map, but is based upon reasonable estimates of the <br />demand placed upon the City as a provider of the commodity of sewer services; and <br />RVPUBNXN4\529585 <br />WHEREAS, the City Council has further determined that the annual increase in the <br />
