FOR THE REMOVAL AND <br />RELOCATION OF 4" ASBESTOS WATER LINE AT DAVIS PARK <br />RESTROOMS AND IMPROVEMENTS PROJECT IN THE AMOUNT <br />OF $7,045.35 <br />DATE: JUNE 5, 2003 <br />BACKGROUND: <br />On March 31, 2003, Terra -Cal Construction (contractor) commenced the construction of the <br />Elizabeth Davis Park Restroom and Park Improvements Project. The scope of work for this project <br />includes removal and replacement of existing asphalt surrounding the baseball field bleacher area, <br />construction of handicap accessible public restrooms, installation of water, drainage and sewer <br />laterals for the proposed restrooms, miscellaneous electrical work, installation of drinking fountain <br />and concrete handicap ramp at parking lot entrance. <br />While excavating for footings and foundation of the restroom building, a 4" diameter asbestos <br />water pipe was unearthed under the proposed footings by the contractor. This asbestos water line <br />services the irrigation system and water supply of Davis Park and is not shown on the approved <br />plan. In order to construct the restroom as shown on the plan it was necessary to re-route the <br />existing water main. <br />ANALYSIS/DISCUSSION: <br />California Public Contract Code — 22050 states that "(a) (1) In the case of an emergency, a public <br />agency, pursuant to a four-fifths vote of its governing body, may repair or replace a public <br />facility, take any directly related and immediate action required by that emergency, and procure <br />the necessary equipment, services, and supplies for those purposes, without giving notice for bids <br />to let contracts. The local agency must make findings, based on substantial evidence set forth in <br />the minutes of its meeting, that the emergency will not permit a delay resulting from a <br />competitive solicitation for bids, and that the action is necessary to respond to the emergency." <br />Since asbestos is a hazardous substance and in order to keep the project on schedule, the City <br />decided to hire the services of El -Co Contractors on Labor and Material basis.
