Item #15
CITY OF COLTON
AGENDA REPORT
FOR THE CITY COUNCIL MEETING OF JUNE 17, 2003
TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS
FROM: AMER JAKHER, P.E., CITY ENGINEER
SUBJECT: APPROVE THE AWARD OF TIME AND MATERIAL CONTRACT
TO EL -CO CONTRACTORS, INC. FOR THE REMOVAL AND
RELOCATION OF 4" ASBESTOS WATER LINE AT DAVIS PARK
RESTROOMS AND IMPROVEMENTS PROJECT IN THE AMOUNT
OF $7,045.35
DATE: JUNE 5, 2003
BACKGROUND:
On March 31, 2003, Terra -Cal Construction (contractor) commenced the construction of the
Elizabeth Davis Park Restroom and Park Improvements Project. The scope of work for this project
includes removal and replacement of existing asphalt surrounding the baseball field bleacher area,
construction of handicap accessible public restrooms, installation of water, drainage and sewer
laterals for the proposed restrooms, miscellaneous electrical work, installation of drinking fountain
and concrete handicap ramp at parking lot entrance.
While excavating for footings and foundation of the restroom building, a 4" diameter asbestos
water pipe was unearthed under the proposed footings by the contractor. This asbestos water line
services the irrigation system and water supply of Davis Park and is not shown on the approved
plan. In order to construct the restroom as shown on the plan it was necessary to re-route the
existing water main.
ANALYSIS/DISCUSSION:
California Public Contract Code — 22050 states that "(a) (1) In the case of an emergency, a public
agency, pursuant to a four-fifths vote of its governing body, may repair or replace a public
facility, take any directly related and immediate action required by that emergency, and procure
the necessary equipment, services, and supplies for those purposes, without giving notice for bids
to let contracts. The local agency must make findings, based on substantial evidence set forth in
the minutes of its meeting, that the emergency will not permit a delay resulting from a
competitive solicitation for bids, and that the action is necessary to respond to the emergency."
Since asbestos is a hazardous substance and in order to keep the project on schedule, the City
decided to hire the services of El -Co Contractors on Labor and Material basis. In addition, the water
distribution system of the park has to be restored at the soonest possible time. El -Co Contractors,
