Delgado, Human Resources Manager 41 <br />SUBJECT: Request Determination of Disability Status for Former Police Officer <br />Kenneth Scott Schiller <br />DATE: March 10, 2003 <br />From February 8, 1982, Detective Kenneth Scott Schiller served proudly as a law enforcement <br />officer, for the City of Colton, until his death on December 28, 2002. <br />ANALYSIS/DISCUSSION: <br />In September of 2001, Detective Ken Schiller was diagnosed with metastatic esophageal cancer and <br />on December 13, 2002, Detective Kenneth Schiller filed an industrial disability retirement <br />application with CAPERS. By law, the City Council is required to make a determination of the <br />member's disability so, today, this item and the companion matter will be presented in Closed <br />Session to the City Council. <br />If the settlement agreement is approved, the City Council is required to issue formal findings, by <br />resolution, stating that Detective Kenneth Schiller was disabled by disease or illness, as determined <br />by competent medical opinion, which rendered him incapable of substantially performing the duties <br />of detective, a position in the Police Department. Additionally, the City Council will also find that <br />the disability arose out of the course of employment thereby declaring it an industrial disability. <br />ENVIRONMENTAL IMPACT: <br />This item does not carry environmental impact. <br />FISCAL IMPACT: <br />There is no fiscal impact to the present budget since CalPERS will determine disability pension <br />payments. <br />RECOMMENDATION: <br />It is respectfully recommended that the Members of the City Council approve and adopt the <br />proposed Resolution thereby determining the disability status of Detective Kenneth S.
