Delgado, Human Resources Manager 41 SUBJECT: Request Determination of Disability Status for Former Police Officer Kenneth Scott Schiller DATE: March 10, 2003 From February 8, 1982, Detective Kenneth Scott Schiller served proudly as a law enforcement officer, for the City of Colton, until his death on December 28, 2002. ANALYSIS/DISCUSSION: In September of 2001, Detective Ken Schiller was diagnosed with metastatic esophageal cancer and on December 13, 2002, Detective Kenneth Schiller filed an industrial disability retirement application with CAPERS. By law, the City Council is required to make a determination of the member's disability so, today, this item and the companion matter will be presented in Closed Session to the City Council. If the settlement agreement is approved, the City Council is required to issue formal findings, by resolution, stating that Detective Kenneth Schiller was disabled by disease or illness, as determined by competent medical opinion, which rendered him incapable of substantially performing the duties of detective, a position in the Police Department. Additionally, the City Council will also find that the disability arose out of the course of employment thereby declaring it an industrial disability. ENVIRONMENTAL IMPACT: This item does not carry environmental impact. FISCAL IMPACT: There is no fiscal impact to the present budget since CalPERS will determine disability pension payments. RECOMMENDATION: It is respectfully recommended that the Members of the City Council approve and adopt the proposed Resolution thereby determining the disability status of Detective Kenneth S.
