Delgado, Human Resources Manager �k <br />SUBJECT: Request Determination of Disability Status for Police Officer Mark Joseph <br />Schultehenrich <br />DATE: March 10, 2003 <br />BACKGROUND: <br />On February 6, 1989, Mark J. Schultehenrich was hired to work as a Police Officer for the Colton Police <br />Department. <br />ANALYSIS/DISCUSSION: <br />On September 20, 2002, Mark Schultehenrich . filed an industrial disability retirement application with <br />CaIPERS. By law, the City Council is required to make a determination of the member's disability and the <br />deadline established is April 9, 2003. Today, this item and its companion matter will be presented to City <br />Council, in Closed Session. <br />Even though the application is for industrial disability retirement, the City Council can proceed to act on the <br />issue of disability retirement by issuing a formal finding stating that Officer Mark Schultehenrich was disabled <br />by an illness, as determined by competent medical opinion, which rendered him incapable of substantially <br />performing the duties of Police Officer, a position in the Colton Police Department. <br />At this time, Police Officer Schultehenrich's industrial disability retirement request will remain pending and <br />when the matter is resolved, it will be brought before this governing body for formal finding on whether or not <br />the disability is industrial. <br />ENVIRONMENTAL IMPACT: <br />This item does not carry environmental impact. <br />FISCAL IMPACT: <br />There is no fiscal impact to the present budget since CalPERS will determine disability pension payments. <br />It is respectfully recommended that the Members of the City Council approve and adopt the proposed <br />Resolution, determining the disability retirement status of Police Officer Mark J.
