Delgado, Human Resources Manager �k SUBJECT: Request Determination of Disability Status for Police Officer Mark Joseph Schultehenrich DATE: March 10, 2003 BACKGROUND: On February 6, 1989, Mark J. Schultehenrich was hired to work as a Police Officer for the Colton Police Department. ANALYSIS/DISCUSSION: On September 20, 2002, Mark Schultehenrich . filed an industrial disability retirement application with CaIPERS. By law, the City Council is required to make a determination of the member's disability and the deadline established is April 9, 2003. Today, this item and its companion matter will be presented to City Council, in Closed Session. Even though the application is for industrial disability retirement, the City Council can proceed to act on the issue of disability retirement by issuing a formal finding stating that Officer Mark Schultehenrich was disabled by an illness, as determined by competent medical opinion, which rendered him incapable of substantially performing the duties of Police Officer, a position in the Colton Police Department. At this time, Police Officer Schultehenrich's industrial disability retirement request will remain pending and when the matter is resolved, it will be brought before this governing body for formal finding on whether or not the disability is industrial. ENVIRONMENTAL IMPACT: This item does not carry environmental impact. FISCAL IMPACT: There is no fiscal impact to the present budget since CalPERS will determine disability pension payments. It is respectfully recommended that the Members of the City Council approve and adopt the proposed Resolution, determining the disability retirement status of Police Officer Mark J. Schultehenrich.
