CITY OF COLTON <br />COLTON UTILITY AUTHORITY <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF OCTOBER 7,2003 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: ERIC FRASER, WATERfWASTEWATER UTILITY DIRECTOR <br />SUBJECT: AUTHORIZATION TO SEEK DETERMINATION OF EXEMPTION <br />FROM JURISDICTION OF LOCAL AGENCY FORMATION <br />COMMISSIONS REGARDING AGREEMENT TO TREAT <br />WASTEWATER FROM UNINCORPORATED COUNTY AREAS <br />DATE: <br />SEPTEMBER 30, 2003 <br />Item #16 <br />BACKGROUND: <br />City staff is seeking authorization from the Colton Utility Authority to send letters to the Local <br />Agency Formation Commissions ("LAFCO") of San Bernardino County and Riverside County <br />requesting a determination that the City is exempt from LAFCO jurisdiction regarding entering into <br />an agreement to accept for treatment wastewater from two developments in unincorporated <br />county areas. The City has yet to enter into such an agreement. However, concurrence from <br />both the San Bernardino and Riverside LAFCO is the first step in consideration of such an <br />agreement. <br />DISCUSSION/ANALYSIS: <br />The City is considering entering into an agreement to accept for treatment wastewater from the <br />currently unincorporated Highgrove area, including the Spring Mountain Ranch project ("Spring <br />Mountain") and the Springbrook Estates project ("Spring brook"). The owner of Spring Mountain, <br />Eastbridge Partners, will contract with either Riverside County Service Area 152-C or with <br />Riverside Highland Water Company to provide the distribution system that will collect and remove <br />wastewater from Spring Mountain. The provider of the distribution system will, in turn, contract <br />with the City to receive the wastewater and treat it at the City's wastewater treatment plant. <br />Eastbridge Partners has asked the City to send letters to both the Riverside LAFCO and San <br />Bernardino LAFCO seeking a determination from each entity that the transaction is exempt from <br />LAFCO jurisdiction and requesting that both entities consider this issue at their October and <br />November meetings, respectively. Once the opinions have been provided, staff and Eastbridge <br />Partners will negotiate and prepare a wastewater treatment agreement for consideration by the <br />City Council at a future meeting. <br />In the meantime, the City must submit its requests to both of these entities as soon as possible in <br />order to have the City's request placed on the October and November agendas for Riverside and <br />San Bernardino LAFCO. <br />FINANCIAL IMPACT: <br />No financial impact is anticipated. The City is under no obligation to pursue the wastewater <br />agreement even if there is a favorable decision from the LAFCO's. <br />ENVIRONMENTAL IMPACT: <br />No environmental impact is anticipated. <br />
