CITY OF COLTON Item #10 <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF AUGUST 3, 2004 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: Amer Jakher, P.E., City Engineer <br />SUBJECT: Set a Public Hearing for August 17, 2004 to adopt a Resolution <br />Amending the Basic Fee for Storm Water Management and the <br />Storm Water Management Fee <br />DATE: July 19, 2004 <br />BACKGROUND: <br />In October 1990 the County of San Bernardino Flood Control District was issued a five-year NPDES Storm <br />Water permit with 16 incorporated cities as co -permittees. The second five-year permit took effect for the <br />period of October, 1995 to October, 2000, and a third permit is now in effect until October 2005. <br />DISCUSSION/ANALYSIS: <br />There is no increase in the Basic Fee for Storm Water Management Fee. Landowners, who have not <br />changed their property usage, will not receive an increase over previous two years fees. The proposed <br />amendment affects only the vacant parcels that have been developed, or have changed to a different <br />designated land use group. The fees collected this will fund the NPDES program for FY 2004-05, which <br />includes the City's operational costs for street sweeping, storm drain cleaning, roadway maintenance and litter <br />control. <br />FINANCIAL IMPACT: <br />Cost to the City's residential and commercial landowners is the same as previous years. The revenue is used <br />to fund the City's NPDES Storm Water Program, as mandated by Federal and State regulations. Without the <br />Storm Water Fees, the General Fund would have to cover the costs for the on-going Storm Water Program, <br />which is budgeted at $589, 165 for FY 2004-05. <br />ENVIRONMENTAL IMPACT: <br />The NPDES Storm Water Program is a part of the Federal Clean Water Act and is intended to improve the <br />Nation's waterways, The Federal Government mandates compliance with the NPDES Storm Water <br />requirements and the State Regional Water Quality Control Board enforces the requirements. <br />CONFLICT OF INTEREST — Gift Disclosure Requirements <br />Not applicable. <br />RECOMMENDATION: <br />Staff recommends that the Council set a Public Hearing for August 17, 2004 to adopt a Resolution Amending <br />the Basic Fee for Storm Water Management and the Storm Water Management Fee as set by the Colton <br />Municipal Code, Chapter 14.01. <br />Prepared by: Maritza Tapia — Administrative Analyst <br />REVIEWTEAM N LY <br />City Attorney: Finance Director:, <br />City Manager: OTHER: <br />
