Item #8 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR THE CITY COUNCIL MEETING OF OCTOBER 5, 2004 <br />TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS <br />FROM: AMER JAKHER, P.E., CITY ENGINEER <br />SUBJECT: AUTHORIZATION REQUEST TO ENTER INTO AN <br />AGREEMENT WITH THE BLUE MOUNTAIN ESTATES FOR <br />THE EARLY COMMENCEMENT OF GRADING IN TRACT NO. <br />16289. <br />DATE: SEPTEMBER 27, 2004 <br />BACKGROUND: <br />Tentative Tract Map 16289 consists of a residential tract development of 92 lot subdivisions, <br />located on the easterly side of New Reche Canyon Road and notherly side of Shadid Drive. The <br />proposed tract is being constructed by Blue Mountain Estates. <br />A request for early commencement of grading was submitted by the Developer prior to recordation <br />of the Tract Map 16289. The City is requiring the developer to enter into a grading agreement to <br />assure completion of the grading operation. Bonds for Landscaping/ Re -Vegetation and Grading <br />Bond are also required as part of the agreement. <br />ANALYSIS/DISCUSSION: <br />The City has received 125 % of Landscaping/ Re -Vegetation Bond for the amount of $551,100.00 <br />and 125 % of Grading Bond for the amount of $ 3,428,900.00. The City has also prepared a draft <br />agreement for the early commencement of grading which the developer will be required to sign. <br />ENVIRONMENTAL IMPACT• <br />An Environmental Impact Report was prepared as part of the Tract Development. <br />CONFLICT OF INTEREST <br />Exact Business Name: Trinity-Peppertree, LLC <br />President or Equal: Wyn Holmes <br />Contact Representative: Wyn Holmes <br />FINANCLAL/FISCAL IMPACT: <br />The grading plan check and inspection fees in the amount of $75,637.50 have been paid by the <br />developer. <br />
