Item #6 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF OCTOBER 19, 2004 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: ANTHONY ARROYO, HUMAN RESOURCES MANAGER / <br />SUBJECT: APPROVE AND ADOPT THE PROPOSED RESOLUTION AMENDING <br />RESOLUTION R-103-98 FOR THE SAN BERNARDINO PUBLIC <br />EMPLOYEES ASSOCIATION (GENERAL UNIT) WHICH ADOPTS <br />EXHIBIT A, THE CONSOLIDATED MEMORANDUM OF <br />UNDERSTANDING. <br />DATE: October 7, 2004 <br />BACKGROUND: <br />The Memorandum of Understanding (MOU) with San Bernardino Public Employee's Association <br />(SBPEA) for the General Unit expired on June 30, 2004. Representatives of the City and SBPEA <br />have been negotiating for a successor MOU over the last few months. <br />DISCUSSION/ANALYSIS: <br />Representatives of the City and SBPEA have reached an agreement, subject to formal City Council <br />approval, with a term ending June 30, 2009. Attached is the Consolidated MOU as Exhibit A. <br />Given the uncertain fiscal issues the City may be facing this year, the General Unit accepted the <br />City's proposal of no salary increase for the 2004/05 fiscal year. Some of the key provisions are: <br />• Enhanced Vacation and Holiday accrual sell back benefit. <br />• Change Association membership to closed shop per Association vote earlier this year. <br />• Change in the grievance procedure from arbitrator to mediator. <br />• Add Management Rights provision. <br />• Salary increases as follows: <br />1. Effective July 1, 2005, 3% of base salary; <br />2. Effective July 1, 2006, 3% of base salary; <br />3. Effective July 1, 2007, 3% of base salary; <br />4. On or before January 1, 2008, the City and SBPEA will complete a compensation <br />study and will meet and confer regarding the implementation of the survey to be <br />effective July 1, 2008. <br />• Implement a"No Smoking" policy in all City owned vehicles and mandate seat belt usage. <br />• Effective January 1, 2005, increase the cafeteria plan to $990 per month. <br />� Add language approved by Council in the last two years to be included in the Consolidated <br />MOU. <br />
