ITEM #15 <br />CITY OF COLTON <br />REVISED - AGENDA REPORT <br />FOR THE COLTON CITY COUNCIL AND UTILITY AUTHORITY MEETING OF JULY 19, 2005 <br />TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL <br />HONORABLE CHAIRPERSON AND UTILITY AUTHORITY MEMBERS <br />FROM: ERIC R. FRASER, DIRECTOR OF WATER & WASTEWATER OPERATIONS <br />SUBJECT: APPROVE THE CHANGE ORDER TO THE CONTRACT WITH ROSS A. GUY <br />& SON, INC. IN THE AMOUNT OF $8,300 FOR THE REPAIR OF THE SEWER <br />MAIN. <br />DATE: JULY 11, 2005 <br />BACKGROUND: <br />On May 8, 2005 City crews responded to a reported sink hole in the alley just west of La Cadena Drive <br />between `L' and `M' Streets. A collapsed sewer line was determined to be the cause of the sinkhole. This <br />sewer provides service to several residences East of La Cadena and flows in a Westerly direction towards <br />7 t Street. <br />DISCUSSION/ANALYSIS: <br />In order to prevent raw sewage from backing up into customer's homes, emergency replacement of the <br />sewer line was necessary. Initially, the work was estimated to be less than $25,000. As such, the City <br />Manager executed a purchase order on May 9, 2005 with Ross A. Guy & Son, Inc. to perform the <br />necessary work. During construction, crews experienced very dry, sandy soil that was prone to collapse. <br />This necessitated the use of additional shoring equipment. The soil conditions resulted in additional time to <br />complete the work in order to work safely, thus resulting in a higher cost than initially anticipated. The work <br />has been completed. <br />The actions of City staff in this instance complied with the city's existing purchasing regulations, which state <br />that competitive bidding, either formal or informal, is not required in situations determined by the City <br />Manager to constitute an emergency for a public project, pursuant to Public Contract Code sections 22035 <br />and 22050, if the City Manager determines that the emergency will not permit a delay resulting from a <br />competitive solicitation for bids and that the action taken is necessary to respond to the emergency. <br />(Colton Municipal Code § 3.08.130) Under such conditions, any alternative procedure may be used. The <br />City Manager has authority to declare such an emergency and take any directly related and immediate <br />action required by the emergency, up to a total of one hundred thousand dollars, so long as his <br />determination is ratified by a four-fifths vote of the City Council pursuant to PCC Section 22050. <br />PCC Section 1102 defines an emergency as "a sudden, unexpected occurrence that poses a clear and <br />imminent danger, requiring immediate action to prevent or mitigate the loss or impairment of life, health, <br />property, or essential public services." The City Manager believed that a collapsed sewer line met this <br />definition, and that there was no less comprehensive way in which to adequately respond to the <br />emergency. <br />FINANCIAL IMPACT: <br />Sufficient funds are available in the Capital Improvement Account 522-8200-8206-3890-0000-000. <br />ENVIRONMENTAL IMPACT: <br />7/10/03 City Clerk's Office Cb <br />
