Zamora, Community Development Director <br />SUBJECT: Consideration of an Appeal of the Planning Commission Denial of a <br />Modification to the Conditions of Approval for a Conditional Use Permit <br />to install a metal storage unit behind an existing church located at 754 <br />Herberts Lane, File Index Number DAP -000-489 (Reference DC -40-90) <br />(La Nueva Uncion, Pastor Hector Luis Jacobo, Applicant). <br />DATE: November 7, 2005 <br />BACKGROUND: <br />The applicant, La Nueva Uncion, is requesting an appeal of the Planning Commission's denial of <br />their request to modify the Conditions of Approval for a Conditional Use Permit to install a metal <br />storage unit behind an existing church located at 754 Herberts Lane (Assessor Parcel Number <br />0160-214-18-0000), and an Environmental Determination that the proposed project is exempt <br />under the California Environmental Quality Act (CEQA), Section 15301. The existing church was <br />approved under a Conditional Use Permit (File Index DC -40-90) in 1990. The Planning <br />Commission considered the applicant's request on September 27, 2005. After considerable <br />discussion and public testimony, the Commission on a 5-0 vote, closed the Public Hearing and <br />continued the item to the October 11, 2005, meeting to afford staff the opportunity to prepare a <br />resolution to deny. On October 11, 2005, the Planning Commission on four (4) affirmative votes <br />and two (2) abstentions denied the proposed project and adopted Resolution Number R-11-05. <br />ANALYSIS/DISCUSSION: <br />The General Plan of the project site is Low Density Residential and the Zoning Classification is R- <br />1 (Single -Family Residential). The intent and purpose of this land use is to provide areas for the <br />development of single-family dwellings on urban size lots. This zone also provides for the <br />development of accessory uses that are related, incidental and not detrimental to the residential <br />environment through a Conditional Use Permit. Such conditional uses include religious <br />institutions, as well as educational facilities and childcare services. <br />A code complaint was submitted to the City Code Enforcement Division on May 2, 2005, <br />concerning installation on site of a non -permitted 8' x 28' sea cargo metal container. An <br />Administrative Citation was issued on August 1, 2005. On August 9, 2005, the applicant submitted <br />a Development Application for Design Review of the storage container. <br />According to the applicant, the metal storage unit is required in order to provide adequate auxiliary <br />storage area for chairs, tables and other items used by the church. The metal structure is not <br />visible from the front of the property. The Design Review Committee and staff supported the <br />proposed project and recommended approval with conditions that it be painted to match the <br />existing church facility and for large potted plants be placed around it to buffer the impact on <br />neighboring residences. <br />
