ITEM #1 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF October 4, 2005 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: Eric Fraser, Water/Wastewater Utility Director <br />SUBJECT: Ordinance to Amend Chapters 3.08, 13.04, 13.16, 15.36 and 18.58 of <br />the Colton Municipal Code Relating to Responsibilities of the City <br />Engineer to Review and Approve Plans <br />DATE: September 26, 2005 <br />BACKGROUND: <br />Currently, the Colton Municipal Code requires the City Engineer to sign off on all plans for public <br />projects, maintenance work and general services projects, as well as other issues. Recently the <br />City Engineer, Water/Wastewater and Electric Utility Departments conferred with the City Attorney <br />regarding whether the Colton Municipal Code could be amended so that the City Engineer is not <br />required to review/approve every set of plans. Specifically, City staff believes that the plan review <br />process for water, wastewater and electrical plans can be streamlined by having these <br />departments handle the review of such plans. <br />DISCUSSION/ANALYSIS: <br />Government Code section 37103 states: "The legislative body may contract with any specially <br />trained and experienced person, firm or corporation for special services and advice in financial, <br />economic, accounting, engineering, legal or administrative matters. It may pay such <br />compensation to these experts as it deems proper." (Emphasis added.) Pursuant to this code <br />section, the City may hire a licensed civil engineering firm to provide the desired plan review <br />services. <br />In order to amend the Colton Municipal Code as desired, the proposed ordinance makes relatively <br />simple changes by adding the phrase "or his designee" to several sections of the Colton Municipal <br />Code. The effect of these simple changes is to allow the City Engineer to designate another <br />licensed civil engineer to review and approve plans for public projects. Through the amendments <br />in the proposed ordinance, the City Engineer would designate a licensed civil engineer, contracted <br />by the City Council as explained above, to review and approve plans for the Water/Wastewater <br />and Electric Utility Departments. <br />FINANCIAL IMPACT: <br />No financial impact is anticipated from the adoption of the proposed ordinance. The proposed <br />ordinance provides only the authority for the City Engineer to designate the review and approval of <br />plans.
