2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />URGENCY ORDINANCE NO. 0-21-06 <br />AN URGENCY ORDINANCE OF THE OF THE CITY COUNCIL OF <br />THE CITY OF COLTON IN ACCORDANCE WITH GOVERNMENT <br />CODE SECTION 65858 ENACTING FOR A PERIOD OF FORTY- <br />FIVE (45) DAYS A MORATORIUM ON THE APPROVAL OF LAND <br />USE ENTITLEMENTS AND PERMIT APPLICATIONS WITHIN THE <br />LA LOMA HILLS / PELLISIER RANCH AREA <br />THE CITY COUNCIL OF THE CITY OF COLTON DOES ORDAIN AS FOLLOWS: <br />SECTION 1. Urgency Findings. In accordance with California Government Code, <br />Section 65858 and in order to protect the public health, safety and welfare, the City Council <br />of the City of Colton finds as follows: <br />A. California Planning & Zoning Law requires each city to prepare and <br />adopt a comprehensive, long-term general plan for the physical development of the City <br />containing all of the mandatory elements required by law (California Government Code, <br />Section 65300 et seq.). The City's General Plan is required to include, in part: <br />"A land use element that designates the proposed general distribution and <br />general location and extent of the uses of the land for housing, business, industry, open <br />space, including agriculture, natural resources, recreation, and enjoyment of scenic beauty, <br />education, public buildings and grounds, solid and liquid waste disposal facilities, and other <br />categories of public and private uses of land. The land use element shall include a statement <br />of the standards of population density and building intensity recommended for the various <br />districts and other territory covered by the plan...." (California Government Code, Section <br />65302(a).) <br />Each city must also periodically review, and revise, as necessary, the general <br />plan. (California Government Code, Section 65103(a).) <br />B. In May 2004, the City Council directed the Planning Staff to undertake <br />a comprehensive analysis and revision of the General Plan beginning with the Land Use <br />Element. Staff and the City's General Plan consultants, EDAW (formerly known as P&D <br />Consultants), have been working to gather information and prepare development scenarios <br />for consideration by the Planning Commission and City Council. EDAW and City staff are at <br />the stage where they are analyzing data for the development of recommendations for <br />proposed development scenarios and land uses. These development scenarios include <br />making recommendations about proposed land uses and building intensities for proposed <br />land use designations. <br />C. City staff have received zoning inquiries and application filings for <br />certain land uses within the Pellisier Ranch Area that have intense and unusual development <br />and operating features. If such land uses were approved, they could be incompatible with <br />the recommendations from EDSPAC (Economic Development Strategic Planning Advisory <br />Committee) and the City Council's expressed vision for these areas. Such land uses could <br />also be incompatible with the contemplated General Plan and zoning revisions, including <br />changes in land use designations and General Plan goals and policies that attempt to <br />mitigate the impacts of intense land uses on surrounding properties. <br />D.
