1 2 3 4 5 RESOLUTION NO. 3677 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON TO DETERMINE THE :DISABILITY FOR RETIREMENT PURPOSES OF A LOCAL SAFETY MEMBER (SECTION 21023.6, CALIFORNIA GOVERNMENT CODE) WHEREAS, the City of Colton (hereinafter referred to _as Agency) is a contracting agency of the Public Employees' Retirement System; and, 6 WHEREAS, the Public Employees' Retirement Law requires 7 that a contracting agency determine whether an employee of such agency, 8 in employment in which he is classified as a local safety member, is disabled 9 for purposes of the Public Employees' Retirement Law and whether such dis- 10 ability is "industrial" within the meaning of such law; and, 11 WHEREAS, an application for disability retirement of 12 Alfred S. Smith, employed by the Agency in the position of Police Lieutenant 13 has been filed with the Public Employees' Retirement System; and, 14 WHEREAS, the City Council has reviewed the medical and 15 other evidence relevant to such alleged disability; 16 NOW, THEREFORE, BE IT RESOLVED that the City Council 17 find and determine, and it does hereby find and determine, that Alfred S. 1$ Smith, is incapacitated within the meaning of the Public Employees' Retire 19 ment Law for performance of his duties in the position of Police Lieutenant 20 as of March 28, 1977; and, 21 BE IT FURTHER RESOLVED that the City Council find and 22 determine, and it does hereby find and determine, that such disability is 23 the result of injury or disease arising out of and in the course of employment 24 p t 25 and neither said Alfred S. Smith nor the Agency of the City of Colton has ' applied to the Workman's Compensation Appeals Board for a determination pur- 27 27 suant to Section 21023.6 whether such disability is industrial PASSED, APPROVED and ADOPTED this 5th day of April, 28 1977. 29 $0 31 ATTEST: 32AL �Ci EN RAMOS, ty�Cl
