1 RESOLUTION NO. 4422 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON AUTHORIZING THE COUNTY OF 3 SAN BERNARDINO TO APPROVE THE COLTON CALIFORNIA PORTLAND CEMENT COMPANY RECLA- 4 MATION PLAN #5 UNDER THE AUTHORITY VESTED BY THE SURFACE MINING AND RECLAMATION ACT 5 OF 1975 AS AMENDED. 6 WHEREAS, the City of Colton currently has no ordinance 7 to comply with the Surface Mining and Reclamation Act of 1975; and g WHEREAS, adoption of such an ordinance involves a lengthy 9 process requiring State approval; and 10 WHEREAS, the City has only one mining operation within the 11 City limits; and 12 WHEREAS, to create an ordinance and commit future staff 13 and City time and expense for , ane singular project is not in the 14 best interest of the City; and 15 WHEREAS, the County of San Bernardino has an existing ordi- 16 nance and has expressed their willingness to assume responsibility 17 for approval of the Colton California Portland Cement Company's 18 Reclamation Plan #5, Exhibit "A"; and 19 WHEREAS, the City of Colton has reviewed Reclamation Plan 20 #5 and found it acceptable; and 21 WHEREAS, the City will retain sole authority to approve, 22 conditionally approve, or deny land development in this area. 23 NOW, THEREFORE, BE IT RESOLVED by the City Council of the 24 City of Colton that the County of San Bernardino is given authority 25 to approve the Colton California Portland Cement Company's Reclama- 26 tion Plan #5 as per the above citations. 27 PASSED, APPROVED and ADOPTED this 21st day of February, 28 f 984.
