R-106-05 <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, CALIFORNIA, <br />PURSUANT TO GOVERNMENT CODE SECTION 21025, MAKING DETERMINATION OF <br />DISABILITY STATUS FOR DANIEL SERVIN. <br />WHEREAS, the City of Colton (hereinafter referred to as Agency) is a contracting agency of <br />the Public Employees' Retirement System; and <br />WHEREAS, The Public Employees' Retirement Law requires a contracting agency to <br />determine whether: (1) an employee of such agency in employment in which he/she is classified as a <br />local safety member is disabled for purposes of Public Employees' Retirement Law; and (2) whether <br />such disability is "industrial" within the meaning of such law; and, <br />WHEREAS, an application for disability/industrial disability retirement of Daniel Servin <br />employed by the Agency in the position of Fire Captain has been filed with the Public Employees' <br />Retirement System; and, <br />WHEREAS, the City Council has reviewed the medical and other evidence relevant to such <br />alleged disability; <br />NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: <br />That The City of Colton finds and determines that Daniel Servin is incapacitated within the <br />meaning of the Public Employees' Retirement Law for performance of his usual duties in the position <br />of Fire Captain, and that Daniel Servin is incapacitated for performance of the usual duties of the <br />position for other California public agencies in CalPERS. Similar positions with reasonably <br />comparable pay, benefits and promotional opportunities with other California public agencies are not <br />available. <br />BE IT FURTHER RESOLVED that the City Council finds and determines that such disability is <br />a result of injury or disease arising out of and in the course of employment. Neither said Daniel Servin <br />nor the agency, the City of Colton, has applied to the Worker's Compensation Appeals Board for a <br />determination pursuant to Section 21166 whether such disability is industrial; and, <br />Reso Servin - reso <br />Pagel of 2 <br />
