SECTION 1.4 <br />OF <br />PROCEDURAL DOCUMENTS <br />AGREEMENT <br />mmv <br />ELECTRIC YARD PCB STORAGE FACILITY AND SUBSTATION ADDITION <br />THIS AGREEMENT is made and entered into this 7th day of <br />August 1990, by and between <br />WYATT CONSTRUCTION <br />(hereinafter referred to as the "Contractor") and the <br />CITY OF COLTON <br />State of California, (hereinafter referred to as the "City). <br />R E C I T A L S <br />WHEREAS, the City, by Resolution approved and adopted, duly <br />awarded the contract to the Contractor, and for further <br />particulars reference is hereby made to the records of the <br />proceedings on file in the Office of the City Clerk and open <br />to public inspection; and, <br />WHEREAS, said works of improvement for which the Contractor <br />was awarded the Contract are set forth herein. <br />NOW, THEREFORE, IT IS MUTUALLY AGREED BY THE PARTIES HERETO <br />AS FOLLOWS: <br />A G R E E M E N T <br />1.4.01 That the Contractor, for the consideration <br />hereinafter mentioned, will do and perform in good and <br />workmanlike manner, all the hereinafter mentioned work or <br />improvements, under the direction and to the satisfaction <br />of the Project Manager all the work to be done under contract <br />in accordance with the plans, specifications and drawings. <br />1.4.02 That the following is a general and abbreviated <br />description of the works of improvement: <br />The Electric Yard PCB Storage Facility at 150 <br />South 10th Street, Colton, California and all <br />appurtenant work in connection therewith. <br />1.4.03 That the Contractor will, at said Contractor's own <br />cost and expense, furnish all necessary materials and labor <br />for said work, and the materials used therein shall comply <br />with the specifications and be to the satisfaction of the <br />PROJECT MANAGER, AND, the Contractor will, within Ninety (90) <br />16 <br />44;n 3 <br />
