STRATTON, CHIEF OF POLICE <br />SUBJECT: Date: <br />INCREASE BAIL FOR COLTON MUNICIPAL CODE 10-31-91 <br />PARKING VIOLATIONS TO COVER MANDATED FEES <br />PAYABLE TO THE SA BERNARDINO MUN3Ee3EP*L COURT <br />BACKGROUND <br />The Police Department needs to increase the fees for the Colton <br />Municipal Code parking violations in an effort to recover part of the <br />cost of labor, materials, and overhead involved in processing these <br />services. <br />DISCUSSION <br />The Police Department issues Colton Municipal Code citations for <br />parking violations. Each citation contains a bail amount for the <br />particular parking violation. Normally there is one violation per <br />parking citation. This bail amount is paid to the City of Colton to <br />clear the citation by the violator. The money goes into the General <br />Fund. <br />The San Bernardino Municipal Court is entitled to receive certain <br />fees for each parking violation. These fees apply whether the <br />violator pays the bail to the City of Colton or appears in court and <br />a fine is levied by a judge. The General Fund is reduced by this <br />amount. <br />Under past legislation, the Court has been applying $1.50 per <br />violation. The $1.50 was split between the Temporary Courthouse <br />Construction Fund and the Criminal Justice Construction Fund. Recent <br />legislation, AB 2142, has increased these fees effective 11-30-91. <br />In addition, the Court has noted that it was under -collecting the <br />fees. The Court therefore will begin receiving an additional $3.50 <br />per violation on 11-30-91. <br />Neither of these fees, which now total $5.00 per citation, were taken <br />into account when the City Council passed Resolution Number R-112-90 <br />in October, 1990.
