TO: HONORABLE MAYOR and CITY COUNCIL Q
FOR: Council Meeting of 5 February 1991 ±
FROM: Jaime R. Aguilera, Director of Community Development 4s/ G
SUBJECT: Letter by Wyatt Construction regarding TT 15102
xtlffeltmLkg
Mr. Wyatt has submitted a request (attached) which indicates that he is requesting N
clarification as to the Council's action regarding Tentative Tract 15102. On December 18,
1990, the City Council discussed the project and there was discussion regarding amend-
ments to Mr. Wyatt's plans. The Council eventually voted to deny the plan, however, it
was unclear if the Council also wished to allow Mr. Wyatt to amend the plan for D
reconsideration.
ALTERNATIVES: A
#1 If the intent was to allow Mr. Wyatt to resubmit the plans with amendments,
then Mr. Wyatt could do so without once again paying all pertinent fees,
amounting to approximately $1,110.00.
#2 If the intent was to deny Tentative Tract 15102 with no other stipulation, R
then Mr. Wyatt will have to pay all fees again, if he wishes reconsideration.
ANALYSIS: E
It has been the case in the past that either the Council or the Commission will deny a project
but concurrently allow a resubmittal for further consideration. It has also been the case in
the past that the Council or Commission will simply deny a project without further
stipulations. The Council has the ability to interpret their decision in favor of either
alternative one or alternative two.
Staff believes that the project could answer the concerns of the opposing residents with
some modifications, if it was allowed to be resubmitted.
11
T
Agenda Report 6490A PAGE 1 OF 2
a1 G s N i ZAL RECORDS A7
ORIGIN"' is03:_ ..........
».....
