Aguilera, Director of Community Development00,00" G SUBJECT: Adoption of Amendments to the Rent Stabilization Ordinance No. 0-19A-89 E BACKGROUND: This controversial Ordinance was given final approval by the voters of Colton in 1990. N Since then, the Ordinance has been applied to several different requests for rent increases by parks and rent reductions by home owners. Staff and the Commission have also implemented the rent regulatory portions to all parks. Our legal staff, represented by Amy York and Julie Biggs from Best Best & Krieger have also been involved in the implemen- D tation of the Ordinance. STATEMENT OF PROBLEM: A Through all these efforts to implement the Ordinance, it has become apparent that there are several deficiencies in the Ordinance. ANALYSIS: R These deficiencies can be grouped into several catagories, 1) legal issues 2) enforcement by staff 3) enforcement by the Commission 4) ambiguities 5) contradictions and 6) inability of the Ordinance to carry out its purpose of protecting mobile home owners from exorbitant E rent increases. ALTERNATIVES: There are a myriad of alternatives, most of which the Rent Stabilization Commission has P considered through the three month review process. All of the changes to the Ordinance are issues that have been thoroughly discussed and reviewed by our legal staff. O FINANCIAL IMPACT: It is staff's opinion that the changes to the Ordinance will not adversly affect mobile home owners or mobile park owners and that the impact to the City is negligible since all operating costs are paid for by the registration fees.
